Had 4 x Euro park PCNs- they cancelled 2 due to their error with payments not assigning to registration plates (would not cancel 2 others - same address, another vehicle, same dates - AUG 24) Now got DCB Legal 'Letter of claim" .. I refer to your letter of claim x 2 (References above)I am writing in response to your letter dated 2nd July 2025, regarding an alleged unpaid Euro Parks Ltd parking charge (Aug 24). Please be advised of the following:
I am the registered keeper, not the driver of the vehicle at the time of the alleged contravention. No evidence has been provided to establish driver liability. As there is no legal presumption that the keeper of a vehicle was its driver on any particular occasion, your client cannot pursue me as driver (see VCS v Edward, 2023). Kindly revert to Euro Parks Ltd with the following:
I have researched the Protection of Freedoms Act 2012 (PoFA) and Euro Parks Ltd must cancel and erase my data, as I am not the liable party and I decline their belated request.Your client has not complied with the conditions under Schedule 4 of the Protection of Freedoms Act 2012 to transfer liability to the keeper.I do not acknowledge any debt to your company.
I will rely upon the case of Simon Clay v Civil Enforcement Ltd and similar cases that have succeeded. The alleged debt is disputed and any court proceedings will be vigorously defended. As your client cannot pursue me as driver or keeper, it would be an abuse of the court’s process for your client to issue a claim against me and I will defend any such claim vigorously and seek costs in relation to your client’s unreasonable conduct
I am sourcing and seeking independent debt advice and as such, I formally request that this matter be put on hold for an additional 30 days.Additionally, I am concerned that you are unlawfully processing my personal data, which was obtained via the DVLA without demonstrating a lawful basis for continued processing under UK GDPR. Accordingly, I now request the following: Under Data Protection Law:
· The lawful basis on which you are processing my personal data under Article 6 of UK GDPR.
· Confirmation of the data source (i.e. DVLA) and your justification for retaining and using it.
· Under Civil Contract Law & Parking Code of Practice: A copy of the original Parking Charge Notice issued.
· Evidence of the alleged contravention (including time-stamped photos if applicable).roof that your client has the legal authority to issue PCNs at the stated location
· A copy of the contract between the landowner (or lawful occupier) and your client showing they are authorised to issue and enforce parking charges
· Evidence the contract is valid for the date in question and covers the entire
Until such time that the above is provided, I request that you cease all processing of my personal data. Continued attempts to contact me without proper justification may constitute harassment and a breach of the Data Protection Act 2018. I reserve the right to report this to the Information Commissioner’s Office (ICO) and to seek redress.
If you persist in processing my data and in the event of filing a court claim, take note that I will file a Part 20 counterclaim for not less than £500. This will be claimed as damages for distress arising as a result of clear breaches of the Data Protection Act (DPA) 2018 and/or the Protection From Harassment Act 1997.
Please consider this a formal data subject request under UK GDPR. A response is required within 30 days.0 -

You say you are being contacted as legal owner but there is no such thing; do you mean registered keeper? That is a very long response to a letter of claim; did you see the recommended response in the NEWBIE sticky second post?2

Yeah i thought it was long, i will have another look and yes I am registered keeper, sorry. New to this.0

DCB Legal know nothing about the cases they take on.
If you tell them you have transferred liability they will lie and fraudulently claim you didn't do it within 28 days so it doesn't count in an attempt to get you to cave in and pay.
