Link - unenforceable debts and now a letter threatening legal action with Kearns solicitors

Have 3 accounts with link . Sent off for CCAs and received letters saying unable to comply and unenforceable. Continued to have letters so I sent letter saying 

’ I have recently received reminders for payments for the above accounts. As per your letters from 4th feb,2025 and 9th dec 2024 you have confirmed you are not currently able to comply with my requests to provide the CCAs for these accounts, therefore until you comply I will not be making any payments. I am also no longer working with my previous debt advisor stepchange.

I now require you to only contact me via hard copy letter, in the post. You are to remove any telephone numbers you may have for me from my file and any further attempt to contact me via letter only ‘ 

Now received letter for one of accounts saying they sold it to LC ASSET 1 S.a.r.l on 29/11/2018 - which I don’t remember ? My letter re unable to comply with CCA came from link themselves in December 2024? New letter today states if don’t contact in 14 days they will pass account to Kearns solicitors for legal process - can anyone help please ?

    check your credit reports to see if there's anything on there from LC Asset.  If there isn't I'd suggest it's statute barred and that LC Asset are just on a fishing expedition.  

    no need to mention Stepchange in my opinion.

    Just checked Experian report - no debt is showing for any accounts through these companies at all . Is there another company that may show them? I was with stepchange for 12yrs - these accounts are all old ones as was paying very small amounts off - my original forum thread was’ stepchange for 12 years’ I finally got round to asking for CCAs which nobody  can produce …… at the moment anyway . But this letter does worry me now ….

    So Link sold the debt to LC Asset in 2018?  And you've never talked/written to them?  Any chance that StepChange was paying something on your behalf?  When did you stop working with StepChange?

    I still wonder if it's a fishing expedition based where possibly the debt might be not quite statute barred and they hope you will just cave.  On the other hand if they have had the debt for 7 years and have never communicated with you and you have never paid anything (even through SC) then they can go whistle.  

    But if you are concerned I would suggest you post them a letter to say you don't recognise them or any debt with them and that unless they can produce a CCA they should ensure that all of your details are erased from all of their systems including those of their solicitors.

    Good luck with it.  I know just how worrying it can be when these things pop through the post, especially after you think everything is sorted.

    It seems bizarre that I sent my request to Link for the CCA and it was them that responded saying unable to comply ? Letter received 9th dec stating this . There is a letter from 21/5/25 and at top it says notice issued by link financial outsourcing limited for LC Asset1.S.a.r.l saying notice of sum in arrears and notice is given in compliance with the consumer credit act - which they have failed to find ! So as they haven’t supplied CCA I didn’t respond . tbh I have never seen this LC asset info and it never showed on stepchange statements but I’ll double check when back in house . 
    All letters are from same link address

    Relax, you are in a good position here.

    Any contact from you will just encourage them more, if they get legal with you, then a letter before action is the first step, this is a document designed to reach an agreement with you, with a 30 day return window, within which you can ask for more information on the debt, inc credit agreements etc.

    They couldn`t provide them before, what makes you think they will be able to now?

    Just let them get on with their little game, if an LBA arrives, come back for further advice.

    They are very clever the way they word things but I have letter admitting they can’t supply CCA and unenforceable so will sit tight

    Is this a LBA ? as this is what I got yesterday . Can’t remember seeing anything about change if debt - link has been dealing with all 3 accounts and stepchange was still listing it as link on statements . I have letters saying no CCAs been found on all 3 accounts  with them . Stepchange were paying till December - was either stepchange for 12 years . But no sign of any debt for these with Experian credit reports for quite a few years

    No, its just another threatening letter.

    They say the "legal process will commence after 14 days" if you don`t engage with them.

    At that point I would expect Kearns to send an LBA to you, as that is the first step in the legal process.

    You can then ask for all the information they hold on the debt, which they likely won`t be able to supply, so it should all end at that point.

    However, they may try to be sneaky and send a claim pack instead, if that happens, post back for advice.
