Parking charge notice Scotland

Hi, I parked OHs car in a Morrison car park in Scotland and a parking charge notice has come in from euro car parks. I have searched forum and find a lot if comments that Scotland is different but might change soon but these are mostly from 2024. So my question is what do i do. Send receipt (if we can find it?) but don't state who was driving or reply as OH (owner) stating that it wasnt myself driving and not name the driver?

Here to help and be helped!

    You can either

    Ignore

    Or

Appeal as the keeper stating that there is no keeper liability in Scotland and you were not the driver,  so go chase the unknown driver ( who shall not be named   )

This is done in the keepers name,  not yours  ( no blabbing about who was driving   )

    Or

Get the landowner to cancel it

    Ownership is irrelevant

Morrisons are the best supermarket in the whole of the UK for getting PCNs cancelled for their customers. Go see the manager and get him/her to cancel. Surprise us if they point blank refuse to do so.
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

  • A few years back the same happened with me in a supermarket car park.  I ignored their first letter, then the second one doubling the amount and also one from a debt collection firm.  Have never heard anything further and nothing affecting my credit file either.  So I'd agree with above and simply ignore.

Assume you are in Scotland.  It's all a BIG try-on, the so called legals like to try it on as well. with scare tactics.

As there is no keeper liability at present in Scotland, and they don't know who was driving, even the DVLA do'nt know who the driver is, It's just a dodgy legal, a few in the industry. tring to scam

No risk of a CCJ from these money scammers UNLESS they win in court, very unlikely. Even then, everyone has a chance to pay as the judge orders NO CCJ
