so the standard time allowed is two hours , with the keying device in the gym you are allowed to stay for 3 hours and the driver was in the car park for about 3hrs and 30 minutes - so an overstay of about 30 minutes - is this a defence worth stating ?0

The point being that you are making the driver defendant front and centre as an entitled legitimate customer
Any possible discrepancy could be poor and inadequate signage, penalising genuine customers, which is clearly not a good business model2 -
