    so the standard time allowed is two hours , with the keying device in the gym you are allowed to stay for 3 hours and the driver was in the car park for about 3hrs and 30 minutes - so an overstay of about 30 minutes - is this a defence worth stating ?

    No need to be so specific at the moment,  more like what coupon mad said earlier 

    Don't do their job for them, authorised is authorised,  let them pick holes in it later

    Gotcha, so something like this : 
    The location is a shared-use customer car park serving several retail and leisure premises, including a gym where extended visits are normal. The defendant was not merely a shopper but a legitimate customer entitled to park for longer, as permitted for gym users. The particulars of claim refer only to an alleged overstay; any overstay is denied. No breach of terms and conditions occurred.

    Yes, looks like a good paragraph 3 to me

    Add and driver to the end of paragraph 2 as well

    The point being that you are making the driver defendant front and centre as an entitled legitimate customer

    Any possible discrepancy could be poor and inadequate signage,  penalising genuine customers, which is clearly not a good business model

    I think that's fine but you'll have to remove the first sentence of para 4 which conflicts.
