Horizon - debt recovery

    If I receive a court letter, then is the advice to then pay ASAP? My confusion is the part where you said a CCJ will be issued but that does not necessarily mean it will be recorded? Am I correct here?

    I remember Visa applications ask if I ever had any CCJ issued etc., in this case I would have to then reveal I had 1 issued isn't it? even if it wasn't recorded since I paid it off?

    And sorry I forgot to mention, the car is registered on a Ltd Company which I used to run which is now dormant. The company is dormant since I cannot close it due to the car which I had purchased through the company when it was active) Not sure if it adds any twist to the already confusing plot of mine!

    If an N1SDT court claim against you using MCOL arrives in the post, you defend it with our help,  as explained in post 2 in the newbies sticky thread in announcements near the top of the forum by coupon mad,  plus the defence template thread in announcements too

    You definitely do not pay it, you defend against it 

    Meanwhile,  take a chill pill

    If a judge issued a judgment against you,  it's not recorded until a period of time set by the judge passes without full payment,  a grace period,  so if the grace period given was 30 days,  you pay it in full promptly 

    Personally,  I would pay it in less than a week or a fortnight at most, to be sure that it gets expunged,  as I mentioned earlier 

    Once paid in full, it's never recorded on the public register,  because its paid in full , before the deadline,  case closed

    Absolutely NOT! You'd defend. It's easy.

    You will NOT get a CCJ by defending a claim.

    But you won't get a CCJ.

    Even If your case went all the way to a hearing and you turned up but lost (very rare) you'd just pay it then. No CCJ. Nothing to declare ever.

    You aren't going to pay off anything. No!

    Come back if you get a claim form. Don't show us the £170 threatograms that we already show you in post 4 of the NEWBIES thread. Ignore those and laugh.

    It has both my Company Name and my name below it.

    I immediately emailed horizon explaining the situation and requested them to consider my next days parking for my actual parking the previous day but they said since it has been 24hours since the parking, they cannot help.
    Very good.

    So you can prove that they know that the payment made was for that parking session. And they have acted unreasonably by then - later - issuing a PCN and thus, they have no cause of action against you.

    That will be VERY useful to win any court claim defence but you aren't at that stage.

    Obviously DR Plus can't affect your credit rating! Ignore them completely!

    OK so any claim would probably come to your company as the Defendant. Which cannot POSSIBLY be 'the driver'.

    Do you still have the NTK? Show us both sides because Horizon have not always managed to use the right words to hold a keeper liable.
