Gunnersbury Park PCN Issued. Now received a Debt Recovery Plus letter. Help on Next Steps.

Hi guys,

I received a letter today from Debt Recovery Plus saying they've been instructed to recover the debt of the initial PCN. Seems similar to DCBL.

I've uploaded the images but whats odd to me Is a few things:

1. I'm sure I sent off an appeal within 28 days. Added below. But I can't find an email confirmation or trace it on their website now.
2. The DRP letter says that this is my 4th letter (from whom) but this is literally the first one I received from them.
3. On the back it again says that a reminder letter was sent (by whom? I assume Gemini Parking Solutions) but I've only ever received the one uploaded here from them.

So my questions are:
1. Are the lies DRP is making enough to get the PCN cancelled.
2. If not, What's the best way to proceed to get this potentially cancelled?

Date of Issue: 04 June 2025
Vehicle Registration: EF70KNE

Dear Sir/Madam,

I am the registered keeper of the vehicle referenced above. I write to formally dispute the validity of this Parking Charge Notice (PCN).

No Admission of Driver Liability

There will be no admission as to who was driving, and no assumptions can be drawn. I am challenging this charge as the registered keeper only, in accordance with my rights under Schedule 4 of the Protection of Freedoms Act 2012 (POFA). You are therefore required to comply fully with the requirements of POFA in order to hold me liable as the keeper, which I contend you have not done.

Grounds for Appeal

1. Inadequate Signage – No Contract Formed

The driver of the vehicle reports that there was no clear, prominent, or legible signage visible upon entering the car park at Gunnersbury Park or within the car park itself. The lack of visible, readable, and properly located signage fails to meet the requirements of the British Parking Association (BPA) Code of Practice (Section 19.3) which states:

> “Signs must be conspicuous and legible and written in intelligible language, so that they are easy to see, read and understand.”


As no clear contract was offered, no contract can be said to have been accepted by the driver. The absence of conspicuous signage at the entrance and around the car park means that any terms allegedly breached were not capable of forming a legally binding agreement.

2. No Keeper Liability Established under POFA 2012

You have not demonstrated that this PCN complies with the strict requirements of POFA 2012, Schedule 4, to hold the keeper liable. For example, you have not provided sufficient evidence that the alleged breach occurred under enforceable conditions, nor that the signage communicated this effectively.

I request that you confirm whether you are relying on POFA to pursue me as the registered keeper. If so, please provide a full breakdown of how your notice complies with every requirement set out in Schedule 4 of POFA 2012. If you cannot, you must cancel the PCN or pursue the unidentified driver instead.

3. Failure to Mitigate Loss

This charge does not represent a genuine pre-estimate of loss. The alleged overstay of a short period of time is not evidence of significant financial loss to Gemini Parking Solutions or the landowner. The charge is therefore punitive and unenforceable.


Conclusion

Given the above, I request that this PCN be cancelled immediately. Should you reject this appeal, I require a unique IAS appeal code so I can escalate this matter to the Independent Appeals Service (IAS). Be advised that I will contest the matter there as well, and any failure to address the above points will be highlighted in that appeal.

    1) NO

    2) Plan A in the newbies sticky thread in announcements near the top of the forum,  a complaint about the pcn to the landlord or landowner or business ASAP 

    Ignore powerless debt collectors letters like from DRPL and DCBL  etc

    Come back to this thread if or when you receive a Letter of Claim or a Court claim
