RAC Car Insurance Legal protection

Hi
Partner hit by a speeding motorbike that was stolen and the rider legged it in another car. Airbags the lot... Loads of witnesses, police said not her fault.  However they havent released her car yet.  She has Legal cover she paid extra for on her policy.  Anyone know if she can hire a car while hers is off the road due to the police having it, and also, when being repaired?  Lastly the car is on an agreement with gap insurance... how might that come into play?  Thanks All

    If the bike was stolen and reported as such. 
    She can hire a car but it would be at her own cost. Report to her insurance claim via the policy. The insurance will deal and provide a car if it's repairable. You haven't said what the car is but by the  sound I'd guess not. 
    Gap insurance will pay the shortfall between what the insurance will pay and the settlement figure. 

    Legal cover might assist with an MIB claim

    Presumably the driver remains unidentified?

    If so it will fall under the MIB Untraced Driver agreement which limits cases to those where the claimant sustained a material personal injury and even then there is a £400 excess on any property damage claim which a hire car falls under. 

    So yes she can pay to hire a car however it's going to be fairly unlikely that she will be able to recover the cost unless the thief is identified. 

    The other thing is to check her own policy, some provide a hire car in the event of a claim (often its an optional extra) however its often capped to 14 or 28 days.
