Hi, thank you for advice, we went to small claims court and my father got a phone call saying that the money will arrive in his account on the Friday. He has received that money so we now have to let the court know but he had to pay £70 court fees, can he claim that back?
Did it actually get to court, or did you simply initiate the court process and that comvinced the retailer you were serious?  I assume the latter because I think the waiting list for court is many months.  If that's the case, then the threat has worked and they've paid up, so no, I don't think you can claim the court fee back from them.

I'm unfamiliar with the rules about whether any or all of the court fee can be refunded in the event of the case not getting to court.  If you've got to contact the court to let them know the retailer has paid up, ask them about the fee.

    I'm glad they paid up.
No, the court won't refund your fees. But being £70 down is better than being £2500 down!

You've missed the boat on that one.  Your initial claim should have been your losses plus court costs.  If you've told the court that the claim is settled, then it's too late to ask for more.
    If it sticks, force it.
If it breaks, well it wasn't working right anyway.
