Holiday insurance claim

Hi can anyone help me?

im claiming from my insurance as I was advised by my doctor I wasn’t well enough to travel. I had kidney and low blood pressure problems starting a month before.
I bought the insurance 6 months earlier when I had no kidney issues.
the point is I didn’t declare any pre existing conditions which I do in fact have, ME and depression.
This medical issue has nothing to do with pre existing.
when my doctor writes the report will I be denied because I didn’t disclose ME even though it has nothing to do with why I didn’t travel? 

I hope this makes sense.

     As you failed to declare any medical conditions they are likely to refuse your claim even though it is unconnected.

    I agree with the above.

    Just to add - it would be virtually impossible to prove that your low blood pressure is not
    being caused by your kidney complaint or ME (or indeed by any medication being taken to treat those)

    Any reason why you didn’t declare the pre existing conditions?

    If just to keep the price down then I would suggest in future you do declare as any failure to do so could result in a very expensive trip next time should you require any medical assistance

    the form that the doctor completes will be asked about any pre-existing conditions / appointments over a period of time

    Had you actually declared those condition it is likely that either the premium would have been higher or they may not have insured you in the first place.

    The relevant legislation is  Consumer Insurance (Disclosure and Representations) Act 2012

    In short it says if a customer makes a false disclosure (ie saying you had no pre-existing conditions) then it comes down to two things.... was it careless or either reckless or intentional. If its the later they can void the policy and void the claim.

    If they accept it was careless, ie you had genuinely forgotten about them, then it comes down to if they would have insured you had you declared them. If they wouldnt have then they can cancel the policy and avoid the claim. If they would have but have charged a higher premium then the claim is reduced by the same percentage so if you should have been charged £200 had you declared them but was only charged £50 because you didnt the claim would be reduced to 25%).

    I think you will struggle to convince them that it was simply careless that you didnt mention it. That said, this is what the law allows them to do but some insurers are more sympathetic than the law requires them to be. There are several ombudsman cases where the insurer has allowed the customer to pay the additional premium and then paid out the claim in full

    Although a pre-existing condition may have no direct bearing on the reason for cancelling the holiday, it may have increased the premium or led to the insurer declining to insure at all.  If you look at the policy details the insurer may also have required any new conditions, occurring after the policy was taken out, to be declared.

    I always work on the principle that insurance companies will try their hardest to wriggle out of paying a claim.
    The OP has given them that opportunity.

    I wonder why they didn't declare those pre-existing condition?

    Many medications have side effects. Conditions are therefore often related.

    Yes, your claim will likely be denied.
    Why didn't you declare them? The question isn't 'do you have any conditions you don't want to be covered for', it's 'do you have any existing conditions' and without this information, the underwriter doesn't have an accurate idea of the level of risk you pose to them. 

    Always, always be 100% up front with insurance companies or you leave yourself wide open to claims being denied.

    You have to declare any and all pre-existing conditions for medical insurance.
    Unfortunately I can only agree with others - your policy is likely to be invalidated.
