I still haven't completed the C1 form yet. I still need details of ISA accounts.Aberdon100 said:

So I take the net value of estate for conformation and add half the value of the property and put this figure in the gross value of estate for inheritance tax section without an explanation of where it came from? I am now a bit unsure what goes in the net value and net qualifying value boxes 24&25.
The link you provided states lots more paperwork to be sent than I presumed. The yougov C1 help guide only mentions the Will and maybe the death certificate, I'm sure someone told me the payment does not get sent with the form. Not quite.
You take the gross value of the estate for confirmation (box 11 value) and add half the value of the house and put this figure in the gross value of estate for inheritance tax (box 23)
The deductions used to give the net value for confirmation (boxes 12/13/14) are deducted to give a net value for IHT (box 24)
You are correct in that there is no explanation entered in the form why the gross value for IHT exceeds the gross value for confirmation.
If all of the estate passes to the surviving spouse, then NQV (box 25) is zero. But legitim entitlement of children needs to be considered (if legitim claimed this alters the NQV, if legitim renounced then NQV stays at zero)
The court will require ID etc.
If you include contact details, the court will phone for card payment when approved.
I had conformation today from the solicitor that the title to their house was taken equally between and to the survivor of my Mum and Dad. I am presuming this is a survivorship clause, is that correct?
Does the proof of ID that gets sent with the form have to be originals or will copies be acceptable?
I am not very sure what to add in the cover letter, is this just a short letter with my Dad's contact details and what we require conformation for?

as above in boldI had conformation today from the solicitor that the title to their house was taken equally between and to the survivor of my Mum and Dad. I am presuming this is a survivorship clause, is that correct?
Yes. So as previous, house share isn’t listed in inventory but value of the share is used in IHT calculations.
Does the proof of ID that gets sent with the form have to be originals or will copies be acceptable?
As stated on SCTS website, need to be originals. Two if attending in person, three if by post.

No special magic about a cover letter. A note from Dad listing the enclosures, stating which certificates (if any) are requested, and giving the telephone contact of the person who will be paying the fee.0 -

Hi, I'm back again. Thanks to your help (buddy9) I eventually managed to get conformation after my Mum passed.
I went into the Sheriffs office and someone looked it over while I waited, pointed out a couple of small errors, I corrected them went back and I was told it was good, I then received it a week or so later.
Sadly my Dad has now passed away seven months after my Mum. I have just started altering the C1 form I had saved for my Mum to get conformation again.
I think it will be more straight forward after doing it so recently but I had a few queries if you could help.
Page 1
Myself and my sister were named in the wills to act as executors if both parents had passed
So I have added both our names to section page 1 section 10.
Page 2
I have changed the declaration to myself and that I am son and executor nominate---------- etc
section 3 - paragraph 2 added my sisters name.
Inventory
When adding heritable estate in Scotland, I presume the full estimated value of their house goes here, does the address or where the estimate comes from have to be added under where it says Heritable estate in Scotland on the inventory list?
The total comes to under £300000
Page 4
16) I have ticked no here for IHT400.
20) There is an issue adding my Dad's NI number. It begins YM but the form does not allow me to type a M, does this mean I have the wrong NI number for him and there is never an M in a NI number?
Page 5
21) I have ticked yes for expected estate.
22) I have ticked no for tax nil rate band.
23) There are no deductions as my Dad's bank paid for the funeral so I have the same figure throughout, in total estate for conformation on page 1, section 6 on page 2, the bottom of the inventory, sections 11 and 15 on page 4
and sections 23 and 24 on page 5.
Any help with this again would be much appreciated.

Box 10 yourself and sister are the entries required here.

I am assuming that the will says in effect that your mother is executor whom failing you and your sister. On this basis, below is a suggestion for the para 2 declaration. If there are any name or address differences from what is stated in the will, these would also need to be included.
That I am
along with [enter sister’s full name] of [enter sister’s address], the executor-nominate of the deceased conform to his will dated the [ x of x xxxx ] which is herewith produced, docquetted and signed by me as relative hereto, and that I am the son of the deceased and the said [enter sister’s full name] is the daughter of the deceased. In said will [enter name of mother as in will] the wife of the deceased is nominated executor primo loco, but the said [enter name of mother] predeceased the deceased.
Inventory
An example below of a heritable entry for a house listed in the Land Register of Scotland (as opposed to the General Register of Sasines). Including source of value - (executor or valuer).
If the estate remains under the IHT threshold, you may wish to select a generous but justifiable house value to avoid/reduce any concerns about capital gains tax if the house is to be sold.
Dwelling house 4 Orr Place, Dundee DD25 6DD
being the subjects described in the land register
of Scotland under title number [enter alphanumeric
title number]
valued by executor
Page 4
Box 20 NI number glitch. Need to write it in.
Page 5
Box 22. if the gross value of the estate is greater than £325,000 then tick yes here. (assuming that TNRB is available)
The inventory is a statement of assets at the date of death. If the bank paid the funeral expenses from money that the bank held in dad’s account, then the inventory should show the account date of death total (including interest) and the funeral expense be shown in box 12 and be used in page 5.
