advice for appeal... im unsure whether to pursue with popla

hello, 

i received a private land parking ticket. when i visited this place i tried to purchase a parking ticket as i always do. it was extremely problematic. the machine took afes like struggling to connect. it timed out and printed one void ticket. i tried again and it completely froze. 

i saw could do ringo, tried to use this but the area has poor signal. i asked my daughter if i could try her phone, again no luck. i tried back at the car, no luck. screen on the machine still frozen. 

i looked at details of what to do, and at this point really frustrating because id now been in the car park a good 15 minutes trying (important because if i had left even at this point i would still have got a ticket) to find the only details for contact at this point were a phone number. i am partially deaf and dont talk on the phone, im registered disabled, im autistic. my communication challenges as per the disability benefits i receive mean i simply cant contact in this way (no not even with relay) my daughter is only 13 and also autistic she couldnt have done this either. 

having now been there more than 15 minutes, we did stay parked to do what we intended, and left within an hour. i felt if i left anyway i was going to get a ticket. and genuinely if i could have phoned then i would have. it feels really unfair because the final straw was that i couldnt phone. 

stupidly i took no pictures. 

so i put in the appeal without looking here first. at this point i couldnt find the void ticket either, not that it would have made a difference, but i now have. it at least shows i did try to purchase a ticket. 

now the appeal has been rejected and i feel like i messed up by not looking here for advice first. 

now im confused what to do. i know the next stage is popla, but due to my health i am struggling with a lot right now and the fear of an extra £40 to pay if its rejected is a lot. 

i also cant see how i can prove it. the car park was when on holiday so i cant go back there to get extra photos. i also havent seen any expamples anywhere of disputes regarding accessible communication when theres a fault. other cars were there and i couldnt see any tickets but im guessing they all had access to ringo... how can i prove that i had no coverage? 

does anyone have any advices? am i just likely to be rejected?

    Why did you drive out past the camera, allowing it to record your leaving time when knowing that the system had failed?

    Why did you drive out past the camera, allowing it to record your leaving time when knowing that the system had failed?
    what other choice did i have exactly? its a tiny car park in woods, theres nowhere to speak to anyone - not that i could have. was i supposed to just not leave the car park? i dont understand what you are suggesting i should have done

    I would not suggest anything. Just musing why people drive past the exit camera, when they know the operator's system has failed them.

    then why say anything, because this makes no sense. if you dont have a suggestion then whats your point here? i had no choice so why does it confuse you? i am deaf and cannot speak on the phone so could not call anyone and id already driven in - so what is it you think people can do? you have to drive out the exit. i guess the point is most people wouldnt would they, theyd phone, which means this is just another upsetting response of someone not understanding the disability barrier i faced that meant i had no choice - youre response is exactly why im upset because thats how the company have treated it, with complete disregard.

    I wasn't disregarding your situation and am totally on your side. I wasn't saying you should have phoned. Wasn't criticising you.

    I am not going to suggest what you could (under these unusual circumstances) have done, given the PPC had frustrated any contract and had entrapped you, by failing to supply a workable payment method.

    But the PCN has arrived now so let's move on and help you.

    Yes, any appeal will be rejected. You can't prove what happened.

    So just try one dispute stage - appeal with the facts, not a template appeal, purely to look reasonable - then totally ignore all the £170 debt demand letters shown in pictures in the 4th post of the NEWBIES thread.

    Tell them if you move house with 6 years.

    Come back if you get a LBC or claim form (see the second post of the NEWBIES thread).
