Advice on Excel parking PCN

Hi, wondering if anyone can advise. I’m registered keeper of a car which was parked in one of Excel parking car parks overnight outside a premier inn. I received two notice to keeper 15 days after the alleged incident(s) (one pcn for the first day and then they issued another for the next day as the car was parked overnight). I appealed stating they could not hold me liable as they failed to issue the notice to keeper within 14 days of the incident. They rejected my appeal. My partner had a mental health breakdown and attempted to end her life. We have two kids so the following months were hell and I forgot to appeal the PCN with the IPS within 28 days. I wrote to my MP who contacted the IPC and got the first charge cancelled. Excel stated they could not cancel the second charge because they had already incurred costs for engaging with a debt collection agency. I sent them a long letter with all evidence explaining that I was the keeper but not the driver, they had sent the notice to keeper too late and all my extenuating circumstances for missing the appeal deadline, proof of my partner being in hospital etc., and also a bank statement from my partners account showing that payment was made for 24 hours of parking in the early hours of the second day. The payment was made from my partners account but I didn’t name the driver at any time in my letter. I cited the new changes in IPS guidance from February 2025 stating that as long as the payment was made before the car exited the car park, then the parking charge should be cancelled. The bank statement proved that payment for the full parking duration was made before the car exited the car park (payment wasn’t made immediately because there is no phone signal in that car park or premier inn and had trouble accessing WiFi until about midnight on the day of the parking event). They have now today issued a notice to driver in my partners name. There is no evidence my partner was driving and I did not state that at any time. The notice to driver has also been issued over 7 months after the parking incident. Is this lawful and what is the best way to proceed now? My partner can appeal as this is a totally new PCN, but is it best to go down the “I wasn’t the driver” path or to submit evidence that full payment was made prior to exit of the car park. Or to try appeal on the basis that the notice to driver has been issued more than 7 months after the event? Excel parking are a member of the IPC if that makes a difference

Your partner should appeal stating that they paid before leaving the site and paid in full, and clearly this is a rogue 5 minute rule case that Will Hurley publicly promised would be cancelled on appeal. So cancel it.
Then she repeats the same at IAS.
If it doesn't work, show us and your constituency MP the IAS joke decision.
Your partner will never pay this but go through the 2 stages and if need be - if the IAS fail to invoke the 5 minute rule ban - I'll show it to Will Hurley.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
