Found out I have a CCJ for a parking ticket late 2024

    Sorry, I forgot to add their lawyers which are DCB Legal Ltd. They had sent debt collectors but obviously that never arrived at my new address.

    In the case that I win - would I get anything back from the £310?

    Dunno where the £310 comes from,  it's £313 for a contested set aside 

    You definitely ask for costs, including the £313, its up to the judge to either award them or defer them to the second hearing   ( or I suppose they could say no, but extremely unlikely   )

    So the original claim was issued by DCB Legal on behalf of VCS, and the current CCJ is £290 or so

    Next question (will it end?!) : Could I not be penalised for having not updated my V5 (which I absolutely now have!).

    You could have been penalised by the DVLA, the fine can be up to £1000, but if you updated the details they won't issue proceedings 

    The parking company or their lawyers will blame you for not updating the dvla,  but the counter is that they should check by tracing you before issuing court papers to the old address

    There are tracing services who specialise in either confirming that an address looks correct or in saying we think that individual now lives at xxxx.

    Costs a couple of quid or less per trace depending upon volumes you put through.

    As above,  credit records, council records,  mobile phone contracts, etc.  all sorts of ways these days, very few people don't leave a digital footprint.   There is a company called Trace who specialise in tracing people,  as do numerous debt collectors like dcbl,  drpl,  zzps etc, its extremely common,  and expected before court proceedings are issued , because the old address is unverified

    My reply already told you that setting it aside includes striking out the claim and all your costs back, as per the BINDING AUTHORITY of VCS v Carr.

    i.e. setting it aside doesn't 'give you a chance to fight it': the hearing ENDS THE WHOLE THING with your £313 awarded back,

    Did you watch the official VCS v Carr CoA hearing when you googled it?

    Did you read the transcript? It's freshly published. We have threads on it.

    Anyhoo, see the section in the NEWBIES thread about setting aside a CCJ and search the forum for a few recent 2025 CCJ threads since the final decision in Carr.

    Copy their WS wording and Draft Order.
