Housing Association tree in back garden a health hazard

We have a Cherry Blossom Tree in our back Garden. It is up against the fence and the roots have lifted the fence and also the concrete path that runs down the garden. It has split the concrete in several places and lifted it by about 1and a half to 2 inches. A surveyor came and looked at the tree in July 2023. Agreed it was a trip hazard and recommended to the HA that it be removed.
Both my husband and I have disabilities and it is stopping us from enjoying our Garden. I informed them several times and the job had disappeared off the system. I made a complaint on 22nd May 2025. I have called and emailed several times, I still have not heard from the Complaints team.
The fence was destroyed by the bad winds we had. We have already paid to gave the fencing done on the right side of our property. We cannot put new fencing on the left side because the roots of the tree are above ground and are growing into next doors Garden.
I have informed the Housing Ombudsman but still have not been allocated a case worker. I don't know what else I can do Any advice please.

You also mentioned paying for fencing to be done so I makes me think your the owner as the HA should pay for repairs if you're a tenant.0 -
Not all Housing Associations or Councils maintain fences, putting responsibility for them onto tenants.
Aunts HA has recently given their tenants free rein over gardening, landscaping including fences, as they will no longer pay for anything garden related.
My Council LL won't maintain outdoor sheds (including those installed by them) and fence issues are considered on a case by case basis.

Instead of emails write proper letters of complaint and copy to local councillor and MP mentionning your circumstances and inability to enjoy garden.
Follow up every four weeks1 -
We are tenants. We are responsible for the fencing. I think in this case though the HA are responsible. When the Surveyor came to inspect it in July 2023. He said that the roots must have been a problem then because, instead of a paved path like the other residents have, our path was concreted.

I called them yesterday, the Customer service advisor was disgusted I had not been contacted. She called me back later to let me know what was happening. Apparently my Complaints handler is away from the Business at the moment. Instead of passing my case to another colleague, I have just been left hanging.1
