Storm claims arent straightforward, its a pain to judge if the weather at the time met the definition of storms in the policy book and if it was actually the storm that caused the problem or if it just revealed poor maintenance.

It sounds like you bought the policy stating there was no business use but have subsequently admitted their was working from home and therefore they are treating it as intentional misrepresentation which under CIDRA would allow them to avoid the claim. So is there working from home? Why didnt you declare it?

Not sure where you get your 77% rejection rate from? Policy Expert, who change their capacity providers from time to time, are the claims handlers not the underwriters, according to certain online sources their claims acceptance rate is 60% whereas Accredited Insurance Europe Ltd is 75% according to another site similar to MSE's parent company.

The average is around 72% acceptance so technically one is a little higher and one a bit lower however this can be a reflection on the strictness of the policy terms and so its somewhat inevitable if you buy a policy based on price alone you are likely to have harder terms and so more claims will be declined as not covered as a consequence. If you look at the other end of the spectrum then the likes of Hiscox have a high 90s acceptance rate but they dont sell policies for less than £1,000 so its no surprise that their terms can be more relaxed.

Where does OP say he was working from home?

He does say the company said there surveyors were working from home so would not attend the premises to assess the claim.

That's Correct the claim handlers work from home, I don't work as retired ,The company refused to asses the damage sent some cut n paste statement about weather.

Have you checked your policy book and the definition of Storm? Some are very vague, others are very specific about needing a windspeed above 58mph and/or rain above 30mm per day. For those that are specific it's fairly easy to look up the local weather stations closest to the insured's address and find what the weather records were for those days.

If they define it as 58mph and the weather station says it was 30mph there is no point spending money sending someone out as you've failed to prove it was a storm.

So, what does your policy state? What was the weather on that date? Is there any reason why the weather where you are may be different to where the weather station is?

Ultimately you register a complaint and include anything you can think of (eg weather station is in a valley and we are on the top of a hill) to substantiate that it was a storm. If they accept it then its more likely they will send out a loss adjuster to inspect the property to try and add more evidence one way or the other on if a storm caused the damage or if it was just in a poor state of repair etc.
