Hi all
Claimant: NCP Ltd
Legal: Moorside Legal Ltd
I would really appreciate advice navigating a complex situation regarding to a CCJ being registered at an old address! It being complex because the original PCN was sent to my correct address (I have no recollection of this) but all communication following the PCN being sent to my correct address was sent to an address I moved from in 2021. I will detail the case so far and my actions in a timeline just to make it much simpler to follow. Please also take into consideration that the car that the PCN relates to was bought in 2024, so has had no ties to any other address then my current car.
October 2021 - moved from address CCJ was issued to (address 1) into a new address (address 2). All bills & utilities were swapped over. I have evidence of this and tenancy ending.
October 2023 - moved from address 2 into my current address (this is my parents address so just cancelled utilities etc instead of transferring over). Evidence of this as well. Evidence of my current address is reflected in all my bills, credit report, electoral roll, gp surgery, DVLA, everything!
February 2024 - bought my current car.
March 2024 - received PCN from a car park (NCP ltd). I have no recollection of this PCN, however this car park is a pain, the machines are always broken and I have appealed a PCN from this car park before as you can pay online after 24 hours which I did and still received a PCN.
June - August 2024 - Trace Debt Recovery took over the PCN. I do not recall any correspondence from them, however they allegedly completed a 'trace' on me on June 16th. Moorside were unable to evidence this when I spoke to them so I have completed a SAR on Trace Debt Recovery and Moorside. Anyway the address that came out of this was Address 1 (that I left in Oct 2021 and have no financial ties to anymore, nor is it my last known address).
February 2025 - I have a defaulted CCJ as Moorside sent all legal paper work to Address 1. They have confirmed this to me. Obviously this defaulted as I did not receive or have any clue about the CCJ, and was therefore unable to cooperate with the debt or defend it.
17 June 2025 - moving into a new home, prospective landlord completes credit check and informs me I have 'half passed' as I have a CCJ.
17 June 2025 - contacted the CNBC via email.
19 June 2025 - off work due to sickness so use the opportunity to ring the CNBC, they confirm it is a parking fine from NCP and their legal team is Moorside Legal Ltd.
19 June 2025 - phoned moorside who 'investigated' they said they would get back to me ASAP. I also sent an email following the call. In this call it was confirmed by them that all their correspondence had been sent to my old address. Address 1.
20 June 2025 - chased Moorside, were unable to update me.
23 June 2025 - chased Moorside, were unable to update me.
26 June 2025 - I responded to Moorside with evidence of my correct address, evidence that I was on the electoral roll during the time a trace would have taken place, evidence of changing my utilities over to address 2, evidence of previous correspondence to Trace Debt Recovery (as they had my contact details) requesting they agree to a consent order to set aside the CCJ. I gave them the deadline of Wednesday 2 July.
30 June 2025 - I phoned Moorside to request to speak to management as my email still hadn't been acknowledged, but was met with a colleague of Moorside who refused. As the first PCN was sent to my correct address they do not feel that they should co operate basically. I did say I had sent evidence over in an email, but they had no idea of this email and that it was with their admin team. It was a completely pointless call, to me they seemed they had no clue of the legal procedures, and had no interest in it either. They ended the call asking me to pay the PCN, I declined. I did also note to them that I am currently heavily pregnant and am diagnosed with an anxiety disorder, so the lack of compliance is distressing and disappointing. I also have requested a SAR from Moorside.
Which brings us to now I am going to submit my N244 this week to set aside my CCJ without consent. I do feel a bit deflated following the response I received from Moorside and now feel quite concerned a judge wouldn't set this aside as the PCN was sent to my original address? Although all correspondence afterwards was then sent to my old address.
Please could I have any advice as to whether you think this is possible for me to set it aside?

25 June 2025 - received an email from Moorside stating the original PCN went to my correct address in March 2024. Trace Debt Recovery then completed a Trace on my and corresponded to address 1. Moorside have no evidence of this Trace that has been completed. Moorside demanding payment within 7 days of PCN.
Just to note here I am unsure why a trace would have been completed, especially as I mentioned previously I appealed a PCN to both NCP & Trace Debt Recovery, following correspondence to my correct address.. so they did have my email address alongside my correct address to. When I lived at address 1 it was for a short period time and except council tax and utilities I kept all my information registered to my current address which is my parents (so I would never experience anything like this!)26 June 2025 - I responded to Moorside with evidence of my correct address, evidence that I was on the electoral roll during the time a trace would have taken place, evidence of changing my utilities over to address 2, evidence of previous correspondence to Trace Debt Recovery (as they had my contact details) requesting they agree to a consent order to set aside the CCJ. It is if they failed to trace your current address, if the CLAIM FORM ( not the PCN ) went to the old address, incorrect service of papers, like this one

You should also send NCP a SAR and contact DVLA to confirm what address was given by DVLA to NCP.0
-
The DVLA informed them of the correct address, however they still sent the claim form/all other ccj paperwork to the wrong address.. it is such a strange situation.0

It's not incompetence, it's deliberate. Easy way to guarantee a default CCJ and then they magically find your correct address to enforce it.
