APCOA Railway Parking charge notice

Hello,

Having read the newbies thread, and searched for well over an hour, I wanted to check that I am submitting the right thing, and check if I should include details of actual payment too.

~8am driver entered Newport railway station car park for a trip to London
Driver tried to pay on the paybyphone app, work card declined, got distracted paying for their ticket, forgot to pay.
~5pm got on a train at Paddington, 530pm started expenses on laptop, realised they hadn't paid. Immediately paid on the app again, went through as used their own card this time.
Got back to the station at ~730pm (delayed train)
As expected, ticket on the car from ~10am - parking charge notice (not penatly charge)

Details on the forum would state just use a POFA appeal:

As your Parking Charge Notice does not comply with the requirements of the Protection of Freedoms Act 2012 (Schedule 4), you are, in law, unable to hold the registered keeper of the vehicle liable for the charge.  I suggest therefore that you contact the driver. As there is no legal requirement placed on the registered keeper to identify the driver, I will not be doing so.

But I want to check if I should post that they actually did pay, just late, would this be better and more likely to be accepted?

Dear Sir or Madam,

I am writing as the registered keeper of the vehicle XXXX XXX to appeal Parking Charge Notice XXXXXXXX, issued on xx June 2025 at 10:xx, at Gorsaf Casnewydd (TrC) – Newport Station (TfW).

Please note this site is subject to statutory control under railway byelaws. As such, the conditions for keeper liability under the Protection of Freedoms Act 2012, Schedule 4 do not apply. Where land is governed by statutory control, the ability to hold the keeper liable is specifically disapplied by PoFA.

The keeper is under no legal obligation to name the driver and declines to do so.

If APCOA believes PoFA applies, please provide:

  • A full explanation of how PoFA Schedule 4 applies to land subject to railway byelaws.

  • Evidence that byelaws do not apply to this land.

Furthermore, payment for parking was made later the same day. This demonstrates a clear intent to comply with the terms, and there was no deliberate avoidance of the charge. Evidence of payment can be provided upon request.

In accordance with the BPA Code of Practice (January 2020, Section 17), operators must take into account mitigating circumstances and demonstrate a fair approach, especially where payment has been made, albeit late.

Given the inapplicability of PoFA and the subsequent payment, the keeper respectfully requests that this charge be cancelled.

And would then attach the proof of payment made too.

Or have I completely missed the point?

    Use the latter,  adding proof of payment if you wish , but definitely NO blabbing about who was driving,  not to anyone 

    Hopefully they will cancel the PCN and mention not to do it again,  lol

    Thanks, just to check, I am okay to appeal this at this stage under POFA having not yet received a notice to keeper?

    I would wait for the NTK PCN letter to arrive,  if you are the RK

    The notice you pictured is a notice to driver,  not keeper

    Goes against everything inside me to not appeal at the "discount" stage, but I believe that's needed  :s

    There is no real discount stage. Its called the mugs discount period for good reason
