Hello,
I have received a parking fine on private land, I had parked in a loading bay because there was absolutely no parking available whatsoever around me and all of the disabled bay’s were full with some not even displaying blue badge’s.
I parked in the loading bay and displayed my blue badge but later received a fine in the post.
I appealed the fine it was rejected and then i appealed to popla for exceptional circumstances and they rejected it also.
Now ZZPS limited is harassing me asking for payment , i have tried to set up a payment plan to clear it but they have advised me that all payments i make will incur a £1.95 handling fee on top of what i already owe… Are they legally allowed to do this?
Where do i stand?? I cannot afford to pay this i have tried explaining but its like talking to a brick wall

They can ask, as collectors, you can choose to ignore them, so do so, see post 4 in the newbies sticky thread in announcements near the top of the forum

you need to read the newbies thread ... where amongst other things you will learn that debt collectors are powerless and should be ignored. block their number. do not call them ever! who was the PPC? where did this dastardly deed take place ?1

Yet again a defective particulars of claim that appears to be non-compliant with PD 16.4 on a number of counts. Should apply for a strike-out. The template defence already covers a non-compliant POC as it pertains to 16.4, so at this stage this is just information.
The PCN and damages amount is £170. Yet the amount claimed is £180.20. Where does the £10.20 come from? Nowhere does it say:PD 16.4(1) Particulars of claim must include— (a) a concise statement of the facts on which the claimant relies;So the claim form fails the test in 16.4(1) since there's no description of what this £10.20 extra is.
#1 of their 3 monetary claims explicitly states that £170 is the amount of the PC(s) and damages, so everything other than interest, costs and court fees is covered by that.
Therefore they're going to say that it's a specified amount of interest from the date of the PCN to the date of the Claim Form, since interest is #2 in their list of monetary claims. ButPD 16.4(2) If the claimant is seeking interest they must— (b) if the claim is for a specified amount of money, state— (ii) the date from which it is claimed; (iii) the date to which it is calculated, which must not be later than the date on which the claim form is issued; (iv) the total amount of interest claimed to the date of calculation; and (v) the daily rate at which interest accrues after that date.
Compound interest at £0.02 per day from the date of issue of the PCN to the date on the Claim Form comes to £5.88, quite a bit short of that £10.20. So if it is interest (and hard to see what else it could be), they're also calculating it incorrectly.
In the event they claim it's interest to avoid the allegation that they're non-compliant with 16.4(1), they're automatically non-compliant with 16.4(2)
A claim for a specified amount of interest in addition to the claim for 8% on a go-forward basis from the date of the claim issuance until judgement (based on a specific enactment) is in breach of 16.4(2)(b)(1),(ii),(iii) and (iv), since they've failed to state the date from which and to which it is calculated and they've failed to explicitly state the total amount of interest claimed to the date of calculation.
