Ticket from parkingeye, now got POFA letter

Options
Hi all,

I received this letter, but was busy with life and forgot about it, now I've received this letter about Pofa. Not sure how to proceed now.

The signs were very small in the car park and I didn't see any of them even though I did try to look for them.

You didn't post a picture of the back of the initial NTK PCN letter,  which would mention what the alleged contravention was,  so please post a picture below of the rear of the first letter,  not the subsequent reminder

Its too late to appeal it,  so plan A could be your best option here,  by complaining about it to PALS if you had a genuine reason for being there

So the vehicle was on site for 185 minutes and PE are stating that no payment was made,  or that insufficient payment was made,  so what exactly happened   ?

No payment or a payment for less time on site  ?

Show us pictures of the signs on that site, presumably it's a pay to park car park,  so was payment made but an incorrect VRM used   ?

You need to give more details about the events during the time from entry to exit

Yes, you already said that,  but I stand by my replies

Presumably no payment was made,  so they issued the non payment invoice in the pictures, which I would do if I were them

You have failed to deal with it until now,  hence the chase up letters

Your argument seems to be based on non payment due to poor and inadequate signage,  so are you prepared to go to court and argue your case before a judge, if they sue you in the future  ?

Depends how likely I am to win.

Personally,  I don't believe that you would win, based on the story so far

Parking Eye will state that it's a pay for parking car park and there are numerous signs,  they will produce a contract with the trust to manage the parking onsite,  especially if the parking fees go to the trust

GSV shows signs at car park N 8 years ago, I have no reason to believe that there are none now , especially as their website has all the details,  a pay before leaving car park,  same as at my local hospital

    https://www.lancsteachinghospitals.nhs.uk/car-parking

Not seeing signs is a weak defence

The average driver like myself would expect that hospitals require payment to park,  that it's not free parking for visitors or patients etc ( certainly the ones in my area are pay to park car parks , usually pay before exit  ), so I would expect that most judges would feel the same way

The only way you could win is evidence of no signs, hidden signs,  vandalised signs etc, which I doubt is possible

So IMHO, based on the story so far,  you will probably lose in court with a bill of around £212 to pay

Others here may disagree with my assessment,  but non payment on a pay to park car park is a hard mountain to climb
