DCB LEGAL SCUMBAGS

Hello Everyone,
Newbie here I’m afraid and I’m looking for help. I’m happy to fight this to the end and's have zero intentions of paying up so let’s beat these scum bags.

So I received a penalty notice on 04/05/24 by overstaying the maximum time period allowed. I didn’t appeal and have ignored all letters ever since. I have now received a letter from dcb legal on 21/05/25 which is a letter of claim. I sent an email requesting they send a copy of the reply for and financial statement via email. They finally replied on 24/06/25. I’m presuming I should fill out this form but not sure which box to tick and I’m pretty sure don’t have to include financial information. I wouldn’t say I have a defence or evidence either but I don’t think that’s the be all and end all.

This a what they sent me. I have already replied telling them they won’t be getting my mobile number nor will I be filling out the financial statement part of the form.

Dear Sir,

We write in response to correspondence received in our office dated 3rdJune 2025.

We have made a record of the contents of your correspondence and noted this on your file accordingly.

Please see the enclosed.

We would ask that you kindly furnish us with your most up to date telephone number and email address, this can be emailed to us at info@dcblegal.co.uk

Alternatively, you can contact DCB Legal Ltd on 0203 838 7038 to make payment over the telephone or online

Kind Regards,

DCB legal

Anyway, I’m waffling on. Your help on the next steps and how to defend myself if they do indeed take me to court will be appreciated.

Thanks
Rich

Definitely wasn't a Penalty Notice,  not if it's ECP

    No filling out forms

Email the LoC response template to DCB Legal,  found in the second post in the newbies sticky thread in announcements,  if not done already

Then await the inevitable court claim pack from the CNBC in Northampton using MCOL to arrive in the post
  • I’m having trouble finding that and what does LOC stand for?

    LoC is Letter of Claim

The newbies sticky thread is right near the top of this forum,  so above your thread,  please study posts 5 and 2 carefully
  • So I found these two LOC. obviously I will need to alter them.

Tell BW Legal this by email:

    Dear Sirs,

    Your ref: xxxxxxx

I am the registered keeper but I wasn't driving the car.  Kindly revert to NCP with the following:

I have researched the PoFA 2012, which I realise does not apply at Gatwick Airport.  NCP must cancel and erase my data, as I am not the liable party and I decline their belated request to name the driver.

Had NCP bothered to actually post the 'ghost PCNs' x2 (original and reminder revealed in the SAR reply but which miraculously BOTH never arrived - or existed...?) I'd have told them the above fact and they could have avoided this waste of time threatogram model.

    Put up or shut up.

If you persist in processing my data and in the event of filing a court claim, take note that I will file a Part 20 counterclaim for not less than £500.  This will be claimed as damages for distress arising as a result of clear breaches of the DPA 2018 and/or the Protection From Harassment Act 1997.

I will rely upon the case of Simon Clay v Civil Enforcement Ltd and similar cases that have succeeded.  Cancel the PCN and crawl back under your respective stones forthwith

Preferably tell your client from me to crack on with cleaning up their act to comply with the incoming statutory Code of Practice.  Groundbreaking improvements would include issuing future Notices of Parking Charge properly and engaging fairly, avoiding involving bulk litigators like you lot in this 'extorting money from motorists' model outed by the DLUHC as a market failure.

As for you: I suggest you stop obsessively reading parking forums (quoting influential MSE posters in your template WS is a constant source of amusement!) and go back to chasing shadows for phone contract and energy providers.

    yours faithfully,

    Or

    Dear Sirs,

    Your Ref. ############

    Proposed Legal Proceedings

    Claimant: xxxxxx xxxxxxxx Ltd

I refer to your letter of claim.

I confirm that my address for service for the time being - assuming you don't faff about and delay any claim - is as follows, and any older address must be erased from your records:

    [Correct address here]

The alleged debt is disputed and any court proceedings will be vigorously defended.

I am sourcing and seeking independent debt advice and as such, I formally request that this matter be put on hold for an additional 30 days, in accordance with the Pre-Action Protocol for Debt Claims 2017 ('the PAP').

I note that the amount being claimed has increased by a hugely exaggerated amount which the Government called "extorting money from motorists".

Don't send me your usual blather about that.

I have two questions, and under the PAP I am entitled to specific answers:

    1. Am I to understand that the additional £70 represents what you lot dress up as a 'Debt Recovery' fee, and if so, is this nett or inclusive of VAT? If the latter, would you kindly explain why I am being asked to pay the operator’s VAT?

    2. With regard to the principal alleged PCN sum: Is this damages, or will it be pleaded as consideration for parking?

    Yours faithfully

They probably will, but all part of the charade. Read the first few posts in the following thread, then dip in and out of other posts in it to understand the pattern. ECP is probably the most prominent of the almost 600 cases I've recorded there. Stay with the plan!

Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

  • I will thanks. I’m in too deep to back down now. My wife earlier was like, just pay them. And I said NO WAY!
