Wife’s parking ticket

my wife went to a car park in Leicester on Rutland street and parked but the pay machine would not work , she couldn’t get signal to pay by phone so she left , and parked in a NCP car park instead , she has been issued a fine for the 13mins that she was there , she appealed but they said that the fine still stands , any suggestions??     Who issued it ?  Council or private   ?

    Its definitely not a fine,  magistrates issue fines,  so it's either a Parking Charge Notice or a Penalty Notice

    The keeper could appeal as keeper,  as detailed in the newbies sticky thread,  first post, please read it,  top of the forum in announcements,  by coupon mad 

    District Enforcement are not going to cancel the PCN,  regardless of any appeal,  meaning that it could end up in court,  where a judge would be more sympathetic to the circumstances and the rejection of the parking contract on offer at that location

    Did the car park signs say anything about this 10 minute rule they claim she violated? 

    Did your wife appeal as the registered keeper and was it to DE? and IAS?

    You could try a complaint to the Landowner (PLAN A) and your MP. It wasn't your wife's fault the PPC's payment methods didn't work, leaving her to find an alternative car park.

    Thankyou , she appealed first to district enforcement , she says that she should just pay it but I think she should take it further and appeal to AIS

    Plan A is by far the best option here,  complain to the landowner or landlord or business 

    She could try an appeal to the IAS , but she should expect it to be rejected,  very few succeed

    We do not recommend paying them, court is a fairer option , especially as she left promptly when she couldn't comply with the parking contract listed on the signs

    I called the company and they’ve sent me their signage from the site that does not state about 10 mins and the lady said that it was non contractual and so it doesn’t need to state it , other people have left reviews saying not to park there as the pay meters don’t work and the site is unrecognisable on the parking app

    Good info from the PPC but you should not be calling PPCs - everything in writing!  The consideration period, which is what they are talking about, is supposed to be a MINIMUM of 10 minutes not a maximum

    Thankyou , I didn’t give them any info about the event , I just asked the question and said I was being told that I had a parking charge as a driver, I also rang a firm that used to be in charge of it RPC , they said I should offer a smaller amount of say  £20 as it was their problem
