Newbie | please help - PCN for parking outside a bay at Navigation Road Metrolink

Hi,

So Ocean Parking handed me a PCN in April for parking outside of the bay (see photos - it's something plenty have done before there that hasn't led to any reprimand).

I consulted a previous thread on Ocean and Metrolink car parks from MSE Forums and the advice seemed to be 'kill it with POPLA'. Here's a TLDR of what I did:

  • I emailed to appeal on the grounds that they a) did not identify the driver & b) are not conducting their operation on relevant land according to Network Rail byelaws, c) there's no evidence of Landowner Authority. I pasted the relevant PoFA 2012 & Road Traffic Act 1988 passages below this. 
  • They responded saying their charge will be upheld & invited me to appeal with the IAS. I declined knowing full well it's a bogus organisation bought & paid for by Ocean and the rest. 
  • I asked them to provide me the 10-digit appeal rejection number that i can take to POPLA. They refused.
  • I told them they're legally obliged to, but got told 'please refer to our previous email on this'.
  • Called POPLA - they said Ocean aren't a member so can't really chase them on it. 
  • Made a formal complaint with Ocean, they got back to me saying that they had acted within the terms & conditions set out in the contract literature displayed around the premises & hence won't be taking the complaint further (of course).
Fast forward to a few days ago when I got a repeat letter of image 1, dated June 13th, reminding me that I need to pay. 

Any advice on the best course of action? And yes, contacting them at all may well have been the death knell for any sort of positive outcome.

    Ignore them 

    Anything you read about POPLA must have been in old threads about Care Parking,  but after they morphed into Ocean Parking they jumped ship from the BPA to the IPC , meaning no POPLA is available 

    You could try an IAS appeal but don't get your hopes up 

    Or

    Ignore them unless you receive an LoC or any court claim
