NtK not PoFA compliant - especially on the dates. Their insistence that it is needs to be reported to the DVLA. They cannot hold the RK liable and their warning is misleading (at best).

Send complaint to both the following mailboxes:

    ccrt@dvla.gov.uk

    KADOEservice.support@dvla.gov.uk
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

So is it correct to say under 9(2)(f) the wording is incorrect on my NTK, it starts off "If within 28 days", should that be "If after the period of 28 days"..... and then there's more inconsistencies.

No, read exactly what the actual paragraph says in the legislation.

Just read it, so its not the wording that needs to be exact, it just needs to have all the correct information on the NTK which is in section 9(2)(f).

Sorry no template. There's quite a difference between 'within 28 days' and 'after 28 days'.

Yep, there is.... anyway I think I'll take the risk and ignore, some are saying that Smart Parking don't usually pursue court action. I will still complain to both the following mailboxes you mentioned:

    ccrt@dvla.gov.uk

    KADOEservice.support@dvla.gov.uk

Smart have fairly recently started issuing claims (after years of non-action), but nothing to concern yourself with, but if you do receive a Letter Of/Before Claim from Smart's solicitors, or a County Court Claim via the Northampton CNBC, come back to this thread for further advice.

Keep us abreast of outcome from your DVLA complaint.
