Parking vs DCB Legal

Hi All, I received a claim from DCB Legal in relation to a parking incident that occurred in 2023. The claim form is dated 28 May 2025, and I submitted my Acknowledgement of Service on 9 June 2025. I am currently in the process of preparing and emailing my defence document.

On the day in question, the vehicle was parked in a private parking area associated with a building. However, the payment machines on-site were not working. I have photographic evidence showing the machines were out of service. I attempted to call the number displayed on the machine to seek assistance but received no response.

As I was unable to make payment at the time, I later emailed the parking company to explain the situation and offered to pay the standard parking charge. Unfortunately, I did not receive any reply, and I am currently unable to locate a copy of the email I sent.

I am currently deciding whether to include this explanation — which is truthful — in my defence, or to proceed with a more conventional legal defence by not admitting or denying who was driving at the time of the incident.  (Image removed by Forum Team)

    Put your truthful version in.

    They'll discontinue anyway.

Please show the claim form, more redacted.

Remove remove ALL the old stuff about the DLUHC and their draft Impact Assessment. That is several paragraphs to be pruned from para 9 onwards.

Then (apart from promissory estoppel) instead of the DLUHC/ Draft IA paragraphs, add the words I suggested here about Beavis ... wording courtesy of @troublemaker22

@Car1980 - thank you I will do that.
@Coupon-mad - many thanks, the claim seems to be quite similar to mine. I've updated the defence template accordingly.

Hi All, I’ve now got a telephone mediation appointment coming up next Wednesday for my parking claim. I vaguely remember reading somewhere about people offering a fiver or a tenner as a goodwill settlement, but I can’t find that thread now.

Not really sure what to expect on the call or how to approach it. Has anyone here been through one of these? What actually happens during the mediation, and is it worth making a small token offer, or better to just hold firm and let it go to court?

    Many thanks!

The mediator called me, told me they'd made an offer (which was essentially pay up the full amount we claim you owe us). I told the mediator I don't owe them a penny and that there's no room for a compromise agreement, that they're a bunch of extortionists. Call ended after 5 minutes.

Mediation is covered in the first 8 steps in the Template Defence thread.
