    29th dec for AOS

    12th Jan for defence submission

    just double checking ta

    "5 added for service dates, 14 days to acknowledge, further 14 from aos total of 33 days from issue date until defence should be submitted"

    28th for AOS, , BUT should be done ASAP really, I wouldn't leave it that long, especially due to the Xmas holidays,  I would have it completed before friday 19th, then relax

    33 days is correct,  but never by a Saturday or Sunday,  so Monday 12th at 4pm, preferably earlier,  all completed on MCOL

    have a good xmas and holiday

    With an issue date of 09/12/25 and providing you complete(d) the AoS after 14/12/25 and before or on 28/12/25 your defence deadline date is 4.00 p.m. on 12/01/26

    OK, I've just filed AOS. 

    1.

    Now, in terms of defence submission, the deadline is 12/01/2025 4pm. But, is there any downside if I submit before 31/12/2025?

    I mean, for step 3 "Wait for your own Directions Questionnaire from the CNBC and then complete & email it to the CNBC", how long does it usually take them to email me, and do I then get a deadline to reply? (apology if missed this information somewhere...)

    I ask this because in January I might only be available (i.e. energy and/or stable internet) between 13 - 16, then 27 - 29...  Then I am back to the UK at the end of January...


    2.

    In terms of defence, I think I will just tailor the basic 10-point template. I will have a detailed look tomorrow and might come back with questions on point 2 and 3 (the bits needed tailoring)... 

    I do not want to add in more unnecessary wordings as 1) I stated in the main post that my awareness was very lacking (no I've never parked in blue badge space, so not that bad) and 2) English is not my first language... 

    Unless you good people have options on any extra point I could add and add value to my defence...

    You can submit the final version anytime between now and the deadline,  but to delay the N180 ( by post,  not by email. ) you could delay it until nearer the defence submission deadline,  i would think that you would get past January that way

    They had 6 years to sue you via MCOL,  so it wont be from 2018

    Nobody said the DQ is emailed.  Nothing from the court is emailed.

    Onto the defence point 3. 

    UKPC stated that "the defendant is pursued as the driver of the vehicle for breach of the terms on the signs (the contract). Reason: parked in a residents' parking area without clearly displaying a valid residents' parking permit".

    1) When I looked at the suggestions list, the only thing which is relevant to mine is "you appealed and they refused it?" I did the initial appeal using the template but not the POPLA one. If my point 3 below is legit, should I include this point 1) or leave it? Otherwise, I would have to rely on this sole point I guess? If so, how should I go about it? As it would be very brief...?

    2) I am not sure from the picture I posted in the main post, one can say that I "saw no signs because they were sparsely placed or it was dark"? This is the only photo they took having "RES.." mark, which is not a full mark. Could it be "REST" or anything else? (I am not joking here...) Other photos were all close zoom in on my car, and a photo of the "contract" sign.

    3) I also just checked the photos they took against me. They only took photos of front wind screen. From the front wind screen, there is another irrelevant parking permit to this case (not sure why they zoomed in on it) and the proof of the free parking fee I "paid". I wonder what if the relevant parking permit they were looking for is at the side window or back window? Could it be used as a response arguing that “The photographic evidence provided by the claimant does not clearly show that my vehicle was parked in violation of the terms. The photos fail to show the absence of a valid permit or any other clear indication that I breached the terms.” (helped by AI) ?

    I wonder if I can get some opinions on my points above please.

    Have we seen the claim form and, in particular, the POC, although from what you have written they are claiming you parked in a Residents spot without a permit; that is what your defence has to refute.  Keep any narrative and evidence until the witness statement.  Your points about appealing cannot really form part of a defence, as they were after the event, except if you want to use it to show that you tried to engage and the claimant as being unreasonable.

    Thanks Le_Kirk your opinion is very constructive. Maybe I should just refute briefly (e.g. stating my refute) to leave myself enough "scope" if/when defence goes into the next stage?
