CCJ from DCB Legal 10 days left

Hi all,

Sorry I’m new to this. I received a parking fine a while back in December 2019 and I appealed it but never received a reply. I thought that the appeal was successful (naive I know) and carried on with my life. I then sold the car in 2020 and moved to a new place earlier this year. I was then away for a couple of months travelling for work and I come back to this letter:

 

I’m really not sure what to do and I work in the financial sector. I can’t afford to have a CCJ as not only will it affect my employment. It will destroy my credit score. I’ve read some of the threads and it’s all quite overwhelming. Could I please get some advice

    Look how darn easily they found you AFTER litigation instead of bothering to trace you. This is a clear abuse of the court process.

    If the claim went to an old address it will be set aside and if they fail to serve the Particulars within 4 months of when they first filed the claim, the claim should be struck out too. And you can ask the judge for your £313 court fee back from the Claimant for the improperly served claim (using VCS v Carr).

    But it takes a few months to do.

    The alternative - it pains me to say - is pay it in full to wipe it sooner. But then you are out if pocket snd this rotten industry has 'extorted' money from you.

    If you can stomach the temporary blip over the Summer on your credit rating, do the CCJ set aside application as a matter of principal so as not to pay a scam, and because it will cost you zero in the end (because VCS v Carr is binding case law). You will never pay the actual PCN.
