Moorside Legal

We received 3 PCN’s in a week from a car park in Cornwall in August 2020. We decided to ignore all letters after reading advice on this site. We now have a letter from Moorside Legal and I am worried now that they will take us to court. We have changed address in this time and they have tracked us down. I have no idea what evidence they have, we think we used the car park as drop off point only but can’t be definite. I feel very strongly about the  unethical nature of these parking companies which is why I have ignored it to date.  Please can you help?

Is that Moorside Legal letter a Letter of Claim giving you 30 days notice   ? If yes study the newbies sticky thread in announcements near the top of the forum,  second post and email the LoC response template to Moorside

After that, you can expect a court claim pack from the CNBC in Northampton using MCOL,  by Moorside Legal,  on behalf of the actual parking company   ( which parking company   ?  )

Just to be safe, I would respond at this point because you don't want them to "accidentally" issue a claim to your old address so they can get a Default Judgment.

Send this to the Alliance Parking Data Protection Officer via  info@alliance-parking.co.uk,  (subject heading: Data Subject Rights – Your Name) and CC  help@moorsidelegal.co.uk.

FAO: Data Protection Officer, Alliance Parking

    Reference - their reference number

I am in receipt of a letter dated x in which your agent, Moorside Legal, claim I am liable for 3 parking charges issued by you.  Any debt is expressly denied and no payment will be forthcoming.

I confirm that my address for service for the time being - is below, and any older address must be ERASED from your records.  I enclose a utility bill/copy of the vehicle V5 (delete as applicable) as proof.

    [Correct address here]

    Yours sincerely

    Name.

Use a suitable proof of address, electricity bill or V5 as they will likely ask for it otherwise.

This approach gives them no excuse whatsoever to issue a claim to the wrong address. It protects you if they do, because you can get any default judgment set aside and claim your costs back as well should the worst happen.
