CCJ - Parking Eye / DCB LEGAL LTD

Options

Hello,

I discovered this weekend that I have a CCJ against me for three unpaid PCNs from 2021. The alleged contraventions took place at a hospital car park within the space of a month; hence they have been consolidated under a single claim by Parking Eye Ltd. From reading through the advice in this forum my understanding is that I have been pursued as the registered keeper of the vehicle at the time of the alleged contraventions.

I never received any correspondence to notify me of any PCN, LBCCC/LBC/LBA or of the CCJ itself. Like many on this forum, I discovered the CCJ via a random financial check. I don’t know at this stage which address the CCJ has been served under as this is not provided in the information from CNBC (called them first thing this morning). I will also confirm that the CCJ was issued in 2024.

Due to my current circumstances, having read up on my options, my preference would be to apply to have the CCJ set aside ideally with consent. The reason being that whilst I do not accept liability, my intentions are to pursue the quickest route to removing the CCJ on my record. Without explicitly stating it, I am more concerned about my credit record than any incurred costs.

Is there any advice on this course of action? I have seen the letter template from @troublemaker22 but unsure if it fits with my intentions. I would also like to understand any risks with trying to settle these debts outside of the CCJ. It appears this isn’t often the route that is pursued (in terms of a consent order with DCB Legal), so want to understand if I’m taking the best route here.

Thank you in advance for any help you can provide.

    Welcome!

Yep use that email first but you do need to know if ParkingEye filed the claim or DCB Legal. You mention the latter, so I assume it was them?

Try the email - but don't wait for a response beyond the end of June.

If they say no, then you must put in a contested set aside application and whilst the wrong address situation makes it a mandatory set aside, some Judges still look at whether defendants filed the application promptly.
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
