Pcn in pub carpark

Hi
looking for some help.
recieved a pcn from Britannia for car being parked in pub carpark without giving reg at the bar, the driver had parked there loads of times and didn’t know about the new system.
pcn shows car entering and leaving with time stamps( driver not visible).
missed deadline to pay £60 as away second letter asked for £100- ignored this. Now have letter from BW legal asking for £170. Do I just wait for notice of claim or do I engage with them now?

    If you have a Letter of Claim from B W Legal giving you 30 days notice,  use the LoC response template to email B W L with your response 

    But 

    If its a debt collection Letter,  ignore for now, because the LoC stage is the time to engage 

    You should have got the pub or pub chain to cancel the PCN,  plan A in the newbies sticky thread in announcements

    Personally I wouldn't reply to a BW Legal letter before claim. They tend to bluff and quite a lot of the time they then give up. I prefer to leave them hanging, unllike with DCB.

    Yep - except if it does get to a hearing, the Judge will think better of you of you tried to engage early. After all, it's just a matter of copying & pasting the standard LBC reply.

    they have taken it to small claims court, I have submitted defence and they have said they intend to proceed, do I just keep going and wait for the court date to come through?

    Yes. Follow the 8 steps in the Template Defence thread that we hope you used when defending the claim. Nothing is different; we don't need updates about the standard letters, N180 or Mediation. All standard. All covered already in the 8 steps.
