APCOA Stansted Airport PCN

Hi All,
I used the Stansted Airport pick-up area and forgot to pay the £7 charge within one day.
I called APCOA to ask if I could pay for the entry that was a week old, and they informed me that a penalty charge is on its way. They also provided me with the reference number for the alleged contravention.
What should I do? I haven’t received anything by post yet. Should I appeal using the reference number they gave me, or wait for the letter (if it ever shows up)?

    Just wondering what if the letter gets lost and never arrives. Do I appeal or not?

    You should never phone  always email/write

    With this being an airport site, i assume you have not said who could have been driving as you will know that this is not relevant land as per PoFA
    From the Plain Language Commission:

    I may have said I was the driver, as I thought I could just pay the £7. Does that mean I can no longer use the keeper/driver appeal?

    Anyone can pay the fee, not just the driver 

    Wait for the NTK PCN letter and follow the keeper appeal process as normal 

    No blabbing about who was driving

    Just to clarify:
    • Even if I mentioned my name/address and that I was the driver during the phone call with APCOA, can I still use the keeper appeal?
    • Also, should I only appeal once I receive the PCN by post, even though they’ve already provided me with the reference number and I can access it on their website?

    Just follow the process, dont overthink this,  even if you made a mistake in the phone call

    Correct,  wait for the official paperwork to arrive first

    Nope it doesn't affect it because they won't join up the dots from a phone call (it's not evidence, it's hearsay: the call could have been from anyone).

    The PCN will arrive at your house as long as your V5C is up to date, in terms of registered address.
    PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

    The PCN has been cancelled. Thank you all for your help again!
  • I just want to say thank you to this group. We used the templates provided in the various threads and were able to have the Stansted PCN cancelled. This is what we sent to APCOA. We made sure to only identify ourselves as the keeper. 

    “To whom it may concern,

    Concerning parking notice ##### for vehicle registration #####. 

    I dispute your 'parking charge', as the keeper of the vehicle. I deny any liability or contractual agreement and I will be making a complaint about the predatory conduct of APCOA to your client landowner.

    As your Parking Charge Notice does not comply with the requirements of the Protection of Freedoms Act 2012 (Schedule 4) you are, in law, unable to hold the registered keeper of the vehicle liable for the parking charge. As a matter of fact and law, APCOA will be well aware that they cannot use the PoFA provisions because Stansted Airport is not 'relevant land'. Therefore, I suggest that you contact the driver. As there is no legal requirement placed on the registered keeper to identify the driver, I will not be doing so.

    The matter between us is closed and therefore cancel the parking charge and remove my personal information from your database or issue a POPLA code where you will auto withdraw.
