Joint mortgage and Child maintenance

Hi I am right in saying my ex has to pay half the mortgage payments as it’s joint after walk on us our daughter is 12 and then pay child maintenance he has said he pay half mortgage and will give me £30 a week child maintenance and my calculations show £450 a month any advice?

You're jointly and severally liable for the mortgage, the bank can pursue you, or your ex for the full amount. It's not the case that they'll only pursue you for half.

Child maintenance will be dependent on the level of your partner's income. Is this better or worse than what he is proposing to contribute?0

Unfortunately a joint mortgage means you are both responsible for all of it; that means if he doesn't pay then you have to. You can't force him to pay half, so you should keep this offer of his in mind when negotiating with him0

Have you discussed plans for the property following the separation?
There can be different options...and they can differ depending on whether married or not.
1 - the property sold and equity split
2 - parent and child remain in property until child reaches x age. Person staying in property would often pay 100% of the mortgage payment during this time and the other person would cover their own housing costs elsewhere
Whether the half mortgage + £30 v's £450 is a good deal will depend on the mortgage payments. They could pay the £450 and nothing more...would you be able to stay in the property paying all the mortgage from your income + £450?0 -

Child Maintenance payments do not take mortgage payments in to account so there will be no amount for that.
Things will be very uncertain for you at the moment.
You could try your local Citizens Advice Bureau for advice or get a 30 minute free consultation with a solicitor
You need to agree with your ex. what happens about the house and mortgage.
1 He pays towards the mortgage
2 He does not pay anything and you pay it all
3 You cannot pay it all and it goes unpaid.
4 You agree to sell house and split equity.
Or, lender than takes action to obtain payment from either of you or ultimately repossess the house.0
