Yes. Employers are fined for incorrect reporting and filing of P11d forms. Don't wait for a HMRC payroll audit to correct matters. There's also the Class 1a National Insurance liability to factor in as well.GEB1969 said:
Used for nothing else so does it need to be on our P11D as a benefit that my employee issues.Niv said:
Your commute to the same place of work every day is 'personal use'. But I presume you mean you don't use it for anything else.GEB1969 said:Bookworm225 said:?
it is your employer's responsibility to decide if there is a BIK to be declared on P11D.
keeping the van at home and commuting from home to work is private use and therefore triggers van BIK
Thank you yes I appreciate that they do the P11d declarations but have been told it is now a BIK and just wanted to check as not used for personal use at allBookworm225 said:?

if you travel to the same place of work ( and then presumably out to different places hence the need for the van ) the home to work mileage is deemed as private , if you aren't travelling to differnet sites from the your base site , there are questions about the necessity to have the van at all0

your employER must put the BIK on your P11D they issue because you have a works van available for your exclusive use which you keep at your home overnight and use it to drive (commute) to your regular place of work.
Commuting is always a private cost, not a business cost and anyway, the fact the van is at home overnight is enough to trigger the BIK even if you never drove so much as 1 meter in it. Technically the test is whether it is available for use, not do you use it. Sitting at your home makes it available for use.
The advantage of a company van compared to a company car is the BIK is cheaper0
