TERMS AND CONDITIONS for “KISS Breakfast x Soap and Glory Breakfast Promotion” (the “Competition”). These terms should be read with our general competition terms at: http://www.bauerlegal.co.uk/radio-competition-terms.html which also apply to this Competition.

These terms and conditions (the “Specific Terms”) for the Competition should be read alongside our general competition terms and conditions at: http://www.bauerlegal.co.uk/radio-competition-terms.html (the “General Terms”) which will also apply to this Competition. Where there is any conflict between these Specific Terms and the General Terms, the Specific Terms shall prevail.

 

1.ENTRY ROUTES AND COSTS

Entries are restricted to one entry per person.

2.COMPETITION MECHANIC AND HOW TO WIN

There will be one winner daily (5 winners in total) of this competition from Monday 9th June 2025 – Friday 13th June 2025 during the KISS Breakfast Show 07:00-10:00, winning the prize as described in 5.0 The Prize.

 

2.1 Registration

·      Entrants must use the online registration form (1. Entry Routes and Costs) to tell us “Why you and your mate deserve to win this epic prize”

·      Entrants must then enter their own name and contact details to be contacted, should they be successful.

2.2 Shortlisting 

Bauer Media’s production team and an independent judge will select a shortlist of entries from all valid entries submitted via the online page during the entry period (Wednesday 4th June 2025 00:01 – Thursday 12th June 2025 16::00). The shortlist will be selected based on which entries the production team and independent judge think will be most engaging on air. 

We reserve the right to shortlist entrants for each on-air competition. Being short-listed does not deem you a winner. You are not a winner until told by the production team after the competition rounds have been executed on-air. 

The shortlisted entrants will be contacted by a member of the KISS production team from Friday 6th June 2025 – Thursday 12th June 2025 and asked to reiterate their entry over the phone and confirm their availability between 07:00 – 10:00 on a specific day Monday 9th June 2025 – Friday 13th June 2025, when the on- air competition stage will take place. 

We will contact 3 entrants to be shortlisted for the competition on the following dates, with only one being brought to air daily between Monday 9th June 2025 – Friday 13th June 2025. If we are unable to get hold of the first shortlisted entrant, we will move onto the next, until one is successfully brought to air. 

·      Friday 6th June 2025 by 12:00pm

·      Monday 9th June 2025 by 12:00pm

·      Tuesday 10th June 2025 by 12:00pm

·      Wednesday 11th June 2025 by 12:00pm

·      Thursday 12th June 2025 by 16:30pm

If the selected shortlisted entrants fails to answer the phone when called, your entry will become invalid. 

On being selected to come on-air does not mean that the entrant has won, and they will only win on being told they are the winner of the competition rounds Monday 9th June 2025 – Friday 13th June. Once on-air the selected entrant must play the below mechanic to win:

-       Each day from Monday 9th June 2025 – Friday 13th June the listener bought to air will be played a song. The song clip will have been produced to sound as if they are under water. Each day the song clip will be different and the song selection will be at the discretion of the KISS production team.

-        The on-air entrant each day (Monday 9th June 2025 – Friday 13th June)  will be asked what song is playing. 

-       If they are correct, they are deemed the daily winner and will the prize (see prize details in section 5).

-       If the daily on-air entrant incorrectly identifies the song they will not win the prize and the prize will be lost from the prize fund[EG1] .

3. ENTRY PERIOD

Entries must be submitted during the following entry period:

Wednesday 4th June 2025 00:01 – Thursday 12th June 2025 16[EG2] :30

 Entries received before the Start Time or after the End Time will be invalid.

4. ENTRY RESTRICTIONS

·      Open to UK residents aged 18 years or over on date of entry.

·      Our employees (and their family members) or employees of any company involved in the Competition, including any Prize Provider, are not permitted to enter.

·      We reserve the right to disqualify any entrant or winner who does not comply with any of the eligibility criteria and/or is in breach of these Terms. We reserve the right to repeat the competition mechanic or any stage of it in order to draw a winner that fulfils all of the eligibility criteria and is in compliance with these Specific Terms.

5. THE PRIZE

Prize package provided by Element London for 2 people includes:

Terms & Conditions:

·      The prize package is for two (2) people over the age of 18, all of whom must be free to travel across the 5th to the 7th of July with the same itinerary;

·      Economy flights from London Gatwick only (inclusive of all applicable airport taxes, fees, and duties); Flight itinerary is as stated in the inclusions and no other routing is available; Flights include one (1) small under the seat bag and one (1) large cabin bag, specific dimensions are provided upon booking; prebooked seats and checked luggage are not included;

·      Return standard train travel from the winner’s nearest mainline train station, economy domestic flights from the winner’s nearest airport or a cash travel allowance of 40p per mile from the winner’s home address only to London Gatwick airport will be provided; Travel arrangements and itineraries are selected at the prize providers sole discretion and not all routing will be available; Travel is provided up to a maximum value of £100 per person any cost above this limit are payable by the winner and their guests;

·      Accommodation is based on two (2) adults sharing one (1) double occupancy room in Marbella; Accommodation will be selected by prize provider at their sole discretion;

·      A valid credit or debit card for incidentals may be required to guarantee your room on check in and therefore at least one of the travellers must possess and travel with a valid credit or debit card;

·      The prize excludes travel insurance, domestic ground transfers, meals and drinks, hotel incidentals, excursions, attractions, treatments, visas, personal expenses and anything not expressly stated in the prize package;

·      All elements of the prize are subject to availability; if unavailable, experiences and items of a similar nature and equal monetary value may be offered at the prize provider’s discretion;

·      Spending money to the value of £250 is provided to the winner only and will be sent via bank transfer to the winner’s nominated account, recipient of funds must be aged 18 years or older;

·      Winners must be free to travel from London Gatwick airport on a flight departing at 12:40 on the 5th July and return from Malaga on a flight departing at 16:45 on the 7th July 2025; no other dates or itinerary will be offered;

·      Once booked, the prize cannot be amended or cancelled;

·      Prize is non-refundable and non-transferable; no cash alternative is available;

·      All travellers will require a passport valid for at least 6 months on date of travel; any necessary visas or insurance are the responsibility of the winner and guests;

·      If the winner elects not to, or is unable to, use part of the prize, the winner will forfeit that part of the prize package;

·      Prize must be taken in accordance with government guidelines and COVID-19 rules and restrictions in place at the time of travel, the arrangement and additional costs for any COVID-19 testing, quarantine accommodation or anything else that may be required is sole responsibility of the winner and guest;

This means that we may use all names, images, descriptions, photographs video footage, and other information, which you have submitted on entry, in any media, without paying you any remuneration therefore and without any time restriction. You also agree that we may film, record or photograph you in connection with the competition and /or the Prize if applicable. We will own these films, recordings or photographs and we may use them publicly, including on the internet, for our radio broadcasts and/or for any promotional purposes. You will also have waived any moral rights or right to payment that you may have had.

 

3.       MISCELLANEOUS.

·      Entries which do not comply with these Specific Terms or the General Competition Terms and Conditions will not be accepted and any entries may be disqualified if we have any reason to suspect that there is a breach of, or non-compliance with, these Specific Terms.

·      Where a competition mechanic involves the answering of questions, the correct answers to questions must match our answers to win (or be sufficiently close in our sole reasonable opinion) to be acceptable. In the event of any dispute about any answers given and whether they are correct, we reserve the right to amend what we deem a correct answer, however we are not obliged to, and our decision in either case is final and no correspondence will be entered into.

·      We are not responsible if you fail to get through when you call / text to enter, or if you lose signal during a call.

·      You are responsible for all costs of entry and where necessary, obtaining the bill payer’s permission. Please refer to your tariff with your network provider for information about charges you may incur for entry into our competitions via any SMS or phone call entry route.

·      We accept no liability for network, technical or signal errors, issues or failures experienced by entrants when entering the competition or at any stage during the mechanic of the competition.

·      Whilst on-air, you must not make any inappropriate, profane, indecent, harmful or offensive statements. If you do so we reserve the right to take you off-air immediately and disqualify you from the competition. You may be also disqualified from the competition at any time if you are incomprehensible, inaudible or if you appear to be driving, intoxicated or likely to offend listeners. Any prize already won may be withdrawn and re-awarded to another entrant.

·      As far as it is lawful to do so we exclude our liability for any losses suffered in connection with the Competition or any element of the Prize.

We may cancel, end or suspend the Competition where we are required to do so in circumstances outside our control. We reserve the right to amend these Specific Terms at any stage during the Competition if such amendment is necessary to facilitate the administration of the Competition.
