Appealing Horizon at Tesco parking charge

I have received a parking charge from Horizon after overstaying in Tesco Dudley car park by just over 15 minutes.

I have drafted (with the help of ChatGPT..) an appeal to send to Horizon, based on there not being any period of parking on the NTK, only entry/exit times and apparently this makes it not POFA compliant.

Is this a valid appeal? Or is there anything else i should do?

Subject: Appeal Against Parking Charge – Registered Keeper (PCN: XX0000000)


This is an appeal by the Registered Keeper. No driver details will be provided.


The Notice to Keeper (NTK) issued does not comply with Schedule 4 of the Protection of Freedoms Act 2012, specifically Paragraph 9(2)(b). It fails to specify the required “period of parking” and instead relies solely on entry and exit timestamps from ANPR cameras, which record time on site — not the duration the vehicle was actually parked.


As such, keeper liability cannot be established. You may only pursue the driver, who will not be identified.


This appeal is therefore a formality. Please cancel the charge or issue a POPLA code. If a POPLA code is issued, the appeal will be upheld due to your failure to comply with POFA.


Do not ask for the driver’s identity. Any further action without cancelling the charge or providing a POPLA code will be considered harassment.

    Thanks i was thinking of trying that first, but unsure if it was the right thing to do since its close to 28 days since the date of breach

    I haven’t recieved a reply from Tesco, from both their WhatsApp and an email to the CEO.
    What would be the best way to appeal? Would this work?


    This is an appeal by the registered keeper - No driver details will be given. Please do NOT try the usual trick of asking for driver details in order to get around the fact your NtK does not comply with PoFA. As there is no keeper liability, therefore, liability cannot flow from the driver to the keeper and so, is an automatic win at POPLA. Please cancel the notice or issue a POPLA code at which point you will auto withdraw.

    Horizon recently improved their notices and they're a lot better at sending them out in time and with most of the POFA wording. They will reject whatever you send them, it doesn't really matter what you say provided the driver remains unidentified.

    Can you not just go into the store clutching your receipt from that day and a copy of the PCN (do keep the original) and get the manager to cancel it, like most posters have done here over the years?

    I kind of don’t have an excuse though, i didn't notice it was 1 hour 30 because it used to be 3 hours and i sat in my car after for a bit.
    Also, i don't have a receipt, because it was my friend who paid and he doesn’t seem to have it anymore..! Maybe it’s worth a go without the receipt?
