Advice on ongoing DCB Legal claim

    The issue date is 22 August 2024 and the PCNs were issued in 2023

    Looking at the claim form there are 3 pcns, yet the total being claimed is only £227.70, as if they are only claiming for one of them

    Here’s an overview - friend had a couple of residential parking fines claiming it was due to not displaying the permit (which she has as a resident). Appealed at the appeal stage admitting to being the driver and having a valid permit which fell into the car unknowingly. 

    After a few months it was passed to dcb legal and she sadly succumbed due to their pressure and involuntarily entered into a payment plan. She defaulted on the last payment and on receipt of the claim tried to make a payment but was advised it had tripled. 

    Decided to defend the claim and has been through all stages and currently now at the WS stage which is due

    Hi, I probably should’ve done this much earlier as slim chances of success but I’ll give a brief overview. Friend of mine is currently at the witness statement stage which is near due - she had a couple of residential parking fines claiming it was due to not displaying the permit (which she has as a resident). Appealed at the appeal stage admitting to being the driver and having a valid permit which fell into the car unknowingly but out of 10, only 3 was cancelled. After a few months it was passed to dcb legal and she sadly succumbed due to their pressure and involuntarily entered into a payment plan. She defaulted on the last payment and on receipt of the claim tried to make a payment but was advised the price has tripled. She has been through all stages and currently now at the WS stage. The other side have provided their own and made several claims including admitting to the charges due to entering a payment plan that was eventually defaulted. Is there any chances of success on this one? Any advice will help

    Really oddly pleaded as if it is a claim 'for three PCNs' but 'only' £100 is sought because sadly she paid them a stupid amount already.

    it's really a breach of contract of a payment plan, but the idiots haven't pleaded the case that way and she will have already paid them more than £300 .. I bet!

    So it is an improperly pleaded claim for extra money (DCB Legal's own add-ons in fact) but written as if it's the 3xPCNs money.

    How much did she already pay exactly under this awful payment plan she was duped into?

    She made payments totalling £410 which they included in their WS (£100 thereabouts was what was remaining)

    OK what exactly does their WS say in those paragraphs please? Take a pic of those pages of their WS. Show us.

    And did she SIGN an actual agreement to pay £510?  She should NEVER EVER have done this. She'd have paid less than £410 had she lost this case!

    Did they attach evidence of that payment plan or just talked about it in the WS? Show us EVERYTHING they have shown the court re the payment plan.

    I completely agree! She should never have but like I said, she simply bowed due to their harassing and threatening ways and wanting it to “just go away”

    There was never a signed agreement, just a payment plan. Also, there was no evidence of payment from them - only spoke about it

    They didn’t provide the said “exhibit 7” so she’s not had sight of it. We’ve carefully reviewed the bundle to ensure this is the case and it’s definitely not included although mentioned
