Parking charges at old address- Letter before claim

Hi all,

I’m hoping to get some advice here please 🙏 Two weeks ago, out of the blue, I received a Letter Before Claim relating to parking charges from 2023 from solicitors acting on behalf of a parking firm. It stated that they had been chasing the charges at a previous address but had traced an alternative address. It detailed on the letter that there were 5 separate parking charges amounting to £170 each, so £800+ in total. 

The charges are for the same car park, around the time our son started training for a sports team in a park. There was confusion about the parking  initially, some parents who started at the club at the same time got parking charges which alerted us to the set up. 

We moved house shortly before the parking charges were issued in 2023 and the car the charges relate to was scrapped just after the last parking ticket was issued. We have evidence from the DVLA that the car was scrapped from our new address. However, although we updated our driving licences as soon as we moved, neither my husband or I remember changing the address on the logbook V5C with the DVLA and this must be why the parking charges have gone to our previous address. 

I responded to the letter before claim to confirm our new address and asked them to erase the old address from their records. I also requested the initial parking charges, further correspondence sent and asked for further action to be halted to allow time for us to review this. 

They have responded today to say they sent the correspondence to the address the car was registered to at the time, outlining it is our responsibility to keep this up to date. They have attached the original parking charges as requested but have stated they will not accept further correspondence from us and further action will be taken at the end of June if payment isn’t made in full. 

I’m not sure where we stand with this. The DVLA were notified that this car was scrapped from our new address a month after these parking charges were issued so a new address could’ve been traced much sooner. For them to chase the charges at an address where they were getting no response from for nearly 2 years and then miraculously find our new address before threatening court action seems massively unjust to me. 

I will speak to the sports club where my son still trains although I know they use a different parking company now and I’m not sure how much they can do at this stage. 

I’d be really grateful if anyone on here has any advice on this, specifically on we stand with the car being registered at our old address at the time of the charges. Will we have any case to argue?  Any advice will be gratefully received.

    Letter was from Gladstones. They’ve also just sent a letter saying they’ve updated the new address but won’t erase the old one so not sure whether to follow this up.
