Removing child from nursery, no notice given

I've even got emails from the setting saying they respect my decision to withdraw my child and withold payment and that clear and immediate action on their part is required to restore trust in the setting.
They're not hiding away from their failings. They've outlined a clear action plan for improvement. Its just not yet implemented.
The problem is, in the Ts and Cs there's nothing in there on their requirements only mine. Surely there's an implied requirement that the setting has to be safe and operating legally?
Could it be the case that even though I can evidence their legal breaches, and their acceptance of such, that they could still hold me to a contractual obligation to pay?
Bear in mind, I'd already given the required notice to withdraw at the end of the term for unrelated reasons, so I can clearly demonstrate I took their terms seriously up until I was compelled to withdraw my child for obvious safety reasons.0 -
