Parking Charge Notice claim discontinued.

Hi, I hope someone can help me with this. I attended court last week only to be told by the usher that the claimant NCP had discontinued the claim. I was not notified of this so took a day off work for nothing.
How do I go about claiming expenses?
I have 2 more cases coming up for the same thing, how do I go about getting them struck out?

Generally, you can't. Unless you can demonstrate unreasonable behaviour or that the notice of discontinuance was served to you improperly. (Is it in your junkmail folder?)
Who was the solicitor? DCB Legal? If so there is evidence of a pattern of behaviour as unreasonable, which is helpful.
Are your upcoming cases the same claimant / location / breach?

You should have asked to see the judge for 5 minutes to claim wasted costs. Should have sat there and insisted. Stayed put and reminded the Usher every 15 minutes!Doughnut1967 said:Hi, I hope someone can help me with this. Send an email NOW attaching proof of your day off (this is already in the NEWBIES thread second post which covers EVERYTHING including an example of an email citing the White Book, to ask about costs after a late discontinuance).PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Yes, DCB Legal, same nonsense, I refuse to display a permit to park on my own property. My lease is the primary document and so on, I did not agree to enter a contract with those idiots. And even if the signs form contract, I am not going to charge myself for parking on my own land.Car1980 said:Generally, you can't. I did ask if I could see the judge, mainly to get something in writing to prove the case was done with. The usher insisted that it would not be possible.Coupon-mad said:

" I refuse to display a permit to park on my own property. My lease is the primary document and so on, I did not agree to enter a contract with those idiots."
FYI - Even the latest unregulated CoP (soon to be replaced by a proper regulated PPCoP by the Government) recognise/acknowledge this scam (Hansard):-
https://www.britishparking.co.uk/write/Documents/AOS/Sector Code Templates/sectorsingleCodeofPracticeVersion1.1130225.pdf
The ppss Code of Practice
"14
Relationship with landowner NOTE 3: Particular care is needed to establish appropriate contractual terms, including the application of parking terms and conditions, in respect of controlled land where leaseholders may have rights that cannot be qualified or overruled e.g. by imposing a requirement on the resident of an apartment block to display a permit to park in contravention of their rights under their lease, or to ensure that free parking periods do not breach planning consents."

So you've copied & adapted blue toffee's email now, as I suggested?Doughnut1967 said:

There was also another poster here last week who said they succeeded in getting costs after a discontinuance.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Hi, I need some advice on what to say in defence. PCN issued Oct 2024. Court claim arrived in post yesterday.
Private hire taxi driver arrives 15 minutes early to pick up customer from home address, customer takes about 10 minutes to get in taxi. Time spent waiting 25 minutes. Technically the driver was not parked.

Post a redacted picture of the claim form after hiding 4 pieces of information, the reference number, the password, the VRM details and the name and address
