Should I pay CCJ or try getting it set aside??

Hi all, 

Appreciate any help I can get. I have read through various other discussions, very useful but haven't found one that applies directly. 

I have recently received a Judgement for claimant relating to a parking ticket dating back to 2022 from euro car parks via DCB legal. I had followed all prior advice in newbies thread however my mistake was i didn't get the defense submitted within the window as i calculated the days wrong and it was a very busy period at work, i was on a work as well etc (i know entirely my fault).

Additionally, my original defense I had submitted followed the guideline in newbies thread and included details such as the ticket was from 2022 couldn't remember the particulars. However i recentl came across a picture in my camera roll showing i had purchased a ticket that day with exact same date on the original claim. Not sure if all this would still matter at this stage though. 

I am still within the 30 days to pay the CCJ as the letter is dated 06/05 so I have until 05/06/25 to pay. I have seen other successful cases submitting n244 but a lot of these were relating to the ccj being sent to an old address or similar address issues.

So i guess my question is should i just pay and be done with it or continue the fight and submit n244.

    You submitted it (late) but on what date did you email the defence to the CNBC? Before the date of judgment?

    Correct I submitted the defence on 08/05/25 but literally the next day i received the judgement in the post

    No I asked whether you emailed the defence before the date / time of judgment (shown on MCOL? If yes, even though you paid it this can be sorted out.

  • @Coupon-mad unfortunately not, date of judgement on the letter is 06/05 so was received in the post 09/05 and my email was sent to them 08/05

    Have you paid a CCJ that is in default, or have you paid it off in time so it doesn't appear on your credit history/file?

    As for the original ticket, do you know why the car received a parking charge notice in the first place? 
    Do you know where the car park was, and if it was a stand alone car park, or one attached to a retailer/landowner? and if so whos car park was it/where was it?

    It may be an exercise in urinating in the wind, but if I was in your situation and the landowner was known i would be looking at making myself a nuisance to them over the actions of their agents with the intention of getting my money back from them 9 the landowner/car park owner)
