Hello,
A basic summary of my situation is that I am Autistic, I have CCJ, I would like to move out of the city because its making me ill and Im worried the CCJ will put off landlords.
I was never given the option for "breathing space" or any other help.
Are there any grounds for applying for the CCJ to be removed/changed whilst I pay off the dept?
any advice would be appreciated, this might be an overshare but im frightened.
thanks in advance,
J

It would help if you explained exactly what happened, i.e. what led to the CCJ? There are sometimes grounds to get these set aside but only if you didn't have a realistic chance of disputing the debt prior to the CCJ being issued, e.g. if paperwork was sent to the wrong address and you actually have a valid defence.0

A set aside application costs £301 now, although remission on the fee may be available if you are on a low income.
However to be successful you need to have a good reason why you did not respond to the original court papers, and you also need a defence to the claim, so unless the debt wasn`t yours or you have some other good reason why it should not be paid, then the judgement was granted correctly unfortunately.
There is no point throwing away £301 only to be unsuccessful.
Most landlords only do what`s known as a "landlord check" which is mainly just to confirm identity etc, if a CCJ is an issue to them, they may ask for a larger deposit upfront, but on the whole, renting somewhere new should not be out of the question.I’m a Forum Ambassador and I support the Forum Team on the Debt free wannabe, Credit file and ratings, and Bankruptcy and living with it boards.
