Long-running dispute with Santander

I am going through a scam by Santander. My solicitor has said \i am unlikely to get the money as the whole thing has taken years of going backward and forward with the company. This was a savings account started by my husband. I have been fighting Santander for years and my solicitor has now joined in but says I am unlikely to get any money back. They say I had a card (didn't) but I cannot prove this and their excuse is that several years in the fight is too long and I have lost any rights to the cash. I am 85 and my husband died 15 years ago and over all that time I have been fighting for my money only to be told my solicitor thinks I have no chance. Is this fair. My husband and I worked hard all our lives and I cannot prove they did not send me a card or check book or bank book nor notify me my money was being taken over by them from alliance and leicester.. I feel very much betrayed and I also feel have let my husband down by not suceeding. One letter from Santander tells me my money was put into a bank managers account and then lost so why am I penalised by taking a long time to try (dozens of phone calls and letters) when the fault is theirs for not sending me statements over all these years. I am sure I am not the only person fighting this bank. They are now closing all their branches in Aberdeen so my chances are slim. Why can't MSE do something for us.

Ultimately you've paid a solicitor and so no one here is going to be able to give better advice than a fully qualified lawyer who's had access to all the materials rather than just a few lines of a rant.
The Law of Limitations is there to ultimately give people closure and remove uncertainty. If it didnt exist then someone could sue you today for something you did in 1958 as an 18 year old. How could you defend yourself? How would you even remember if you did bump into the person or not? Imagine the 8% interest's impact on what was due over 4 decades!
So ultimately thats why we have timelimits and most of them are very generous with simple contracts being 6 years. Of cause when someone is being pursued they think 6 years is too long but when they are the pursuer and they've left it 7 years then they think its too short. Ultimately it's what the UK government has decided so we have to live with it either way.0 -
'Money put into a Bank Manager's account' could mean a suspense account or where they place dormant account money.
