Cancelling Online Order

I ordered a shed through Wayfair and was given a delivery date. On the day I received an email saying delivery had been rescheduled to the following day. The next day I stayed in again, and again it was not delivered. Instead I received an email saying delivery was attempted but as I was not in delivery was rescheduled again for the following week. I contacted Wayfair straight away and informed them I was in and the new date given would be too late. I asked for the order to be cancelled. On the rescheduled date the shed arrived and my son accepted delivery. I contacted Wayfair yet again and eventually was told, as the shed was in transit when I requested cancellation it was not possible to return the item. Instead, if I no longer wanted it I would have to pay £50 for them to collect it or organise return myself. Is this correct? Had the shed been delivered on either the 1st or 2nd date given, I would have been happy but the 3rd date was just too late. Any advice would be much appreciated.

    What are the terms of the contract?  Under laws related to distance selling you may return an order within 14 days of receipt for a refund.  What do their terms say about this £50 charge?

    If the date was too late then you/your son should not have accepted delivery.  Since the item was successfully delivered, another courier needs to be scheduled to return the shed.  I don't think the retailer has done anything wrong here - it's a case of you changing your mind after accepting delivery - so I don't think you've got much hope of the retailer covering the cost of a return.

    Was delivery by a certain date specified by the OP either on ordering or when in conversation with Wayfair regarding the delayed delivery?  If not, I agree with Mark_d above that the company has done nothing wrong.  If the OP no longer wants the shed the simplest solution is to suck up the £50 cost.  Annoying to say the least, but the most pragmatic solution.

    Thanks everyone.  I did not say originally that it had to be delivered by a certain date 1) because the date given was a few days before the date needed anyway and 2) I couldn't see where to detail this.
    I didn't just cancel on a whim, I tried to cancel because the 3rd date given was too late and I explained this in my conversations with them.  Had I been told when I contacted Wayfair that it would not be possible to cancel then I would not be posting this.  As it was, I was left with the impression that it would be possible because I had not been told otherwise. Had delivery been refused then I would have only been given a partial refund ie the £50 return fee would have been deducted.  Refusing delivery would also mean that I would not have any proof of return and may not have received any refund at all (according to the Wayfair website).  I agree that the most pragmatic solution is to forfeit the £50 but what I am most annoyed about is the fact that I should not have to because if the shed had been delivered on either of the first two dates given, there would have been no problem at all.  However, it wasn't and that was not my fault so why should I be £50 out of pocket? Surely the buyer should have some protection from situations that have arisen because the courier reschedules, in my case more than once.

    Is it supplied by Wayfair or does it come direct from a 3rd party (manufacture)?
