Group Nexus Parking Notice Scotland.

Hello just looing for a bit of advise please.

Got a parking fine notice from Group Nexus today for when we were out at a retail park with multiple stores in.  We were sofas hunting and went round quite a few stores trying them out,  and we  did some shopping and lunch while there.  We did buy a sofa, but this has taken shine off it.

It turns out there was a 3 hour limit with no return within an hour that we never noticed at the time and over stayed by  hour 4 mins.  It was a big retail par so we moved car a few times but never exited the retail park.

Anyway this was on 12th of May and only received notice today 29th May.  They claim to have issued fine in 21st of May and it only arrived today, taking 8 days to arrive!  This is therefore out with the 14 day time period they have to serve if it is on receipt of notice and not on day they claim it was issued.

Sadly no evidence of posting on envelope other than orange RM barcode that I cant decode, but apparently does have postage date.

Also their letter does show our car with closeup of registration plate but the entry/exit images are not barcoded.  They do state a time of entry leaving in their letter though.

Any help greatfully recieved

    Scotland? Ignore it completely as there is no keeper liability yet and nothing will happen except debt demands.

    Those are nothing but the way to kick it into touch now, is to complain to the retail park and insist it is cancelled.

    Either way, no need to appeal. Certainly no paying!

    Should I go back to sofa store, or Dunelm/Costa who we also shopped at and ask them to get it cancelled or the retail park owner.  Not sure who owns the park.

    If I ignore it, can they pass on to debt collector and impact my credit score or do they have to take me to court which will likely cost them more than they will receive back?

    I just wonder, if not enforceable in Scotland, why do they operate at all? Is it just in the hope that some people will automatically pay.

    I read that it is implied if you park you agree to their contract terms.  However if all they have is ANPR data, could you claim you went round their car park for hours and didn't stop? ;-) Surely they would have to prove otherwise.

    Of course the debt collector letters can't impact your credit score. We'd never tell people to ignore letters that could do that.

    Yep.

    as the law is changing in about a year. Obviously not affecting this piece of hamster bedding!

    If it's a multi retail shops' car park, it's likely there's a Managing Agent responsible for contracting Group Nexus - complain to them. Here below is some advice I give from time to time regarding discovering who a landowner might be:

    SOME IDEAS FOR DETERMINING WHO OWNS THE LAND 

    1. Google searches
    2. If a retail park, check on any signage which lists the on-site outlets
    3. Ask retailers on the site if there is a managing agent
    4. Ask retailers on the site to whom do they pay rent
    5. Contact the local authority and ask who pays the non-domestic/business rate for the car park (some councils have a spreadsheet on their website)
    6. Contact the local Valuation Office and ask if they know. They often have a website which might provide the information 
    7. Contact The Land Registry and for a small fee they should be able to provide definitive detail
    8. If you haven't already done so, give us the name of the car park/site/location, we may have seen other cases there.

    It was at AbbotsInch Retail Park in Paisley Scotland.

    I am going to try the Sofa company (Oak Furniture Land) next week, got nothing to lose and hope they have some say as it impacts their customers.  Will also let me read the small print on signs on who GN are contracted too as I think it needs to be on signs if I am correct?

    Ask the shops who the managing agents or landlords are, its those agents that hired GN

    Check the retail park totem too

    Did you do the search I suggested and learn what is changing when this rogue industry becomes regulated?

    Scottish drivers all need to be ready. Not that it affects this invoice of course.
