    Hi all,

I have been on a nice long holiday, came back to a letter to a hearing date next month.

A few points to note, I did miss my mediation by 10 minutes, as I was waiting for a letter of the date.

I will start by saying they did send me an email (missed it so admit my fault!) But they called my mum…., I don't know how or why. I was on a towing course so couldn't answer till I pulled over which was too late. I had missed calls from my mother then missed calls and voicemails from the court. Showing they called her first… She also gave them my number to call me.

I then called the court mediation when back in the office. They stated they hadn't called my mother but they had and they told her it was the court calling and if I didn't answer I would be summoned to court, this did scare her quiet a lot, after first thinking it was just spam (is that okay with GDPR?) . On the call to the court I asked why a letter hadn't been sent, they stated an email was sent (which I missed) then a reminder text is sent. I never received this text but guess who did receive the text… yes my mother the day before, she never said anything as she thought it was once again spam. (she has sent me screen shot of this). As everything I have received has come by mail even my letter of the now hearing date I thought this would of been the same for the mediation.

I have also received another letter from The Parking Space of a reduction of cost by 25%.

My wife is begging me to take it, She is an accountant and is petrified that a if I receive a CCJ it will go against her.

A CCJ only goes on your credit file if you lose and then don't pay the full amount in the time specified.

I'm a random person on the internet. I hold no legal qualifications and nothing I say is advice.

As an accountant she should know that invoices should be paid promptly, to prevent further action, so if the defendant loses in court, pay the lawyers the full amount awarded by the judge, promptly, ideally within a few business days, ergo NO CCJ

Meanwhile, get the WS completed before the deadline on the court order, possibly this month !

What is the WS? agreed on the invoice promptly but with neither of us been anywhere near a court or CCJ no idea how they worked.

Study the 8 steps in the defence template thread in announcements, then study post 2 in the newbies sticky thread in announcements near the top of the forum ( WS is Witness Statement. )

I have never been anywhere near a court or CCJ too, but thats what research does, fills in the gaps, and I have done years of research and reading

The main point is, if a court rules that a defendant must pay the claimant an amount of money, in full, within a month, that defendant should definitely do what they were told by the court ( the judgment being the amount awarded to the claimant. Especially when the defendant is in fear of the consequences for not doing so
