Parking Penalty Notice - APCOA railway station - Help please

Hi. I parked my car at the railway station and paid through the Apcoa app (only way to pay). You can't pay in advance any more so i booked it on the departing train. I used the correct location code which i got from the website. i paid for '1 day'. When i returned the next day i got a penalty parking ticket from transpennine express for £50. They state the the ticket expires at midnight and does not cover 24 hours. My argument is that nowhere on the Apcoa connect app does it state that payment is up to midnight. It is very misleading. It was a genuine mistake and my appeal has been turned down. They say the signage at the station is clear (I'm not sure about this), and i didn't look at the signage as i booked via the app. The image shows the options for payment . The receipt does state the time at midnight but i was not emailed this and only looked later on the app. As stated you pay after parking when on your train. Do i have a case and if so what are my options.

What a shame you appealed telling them who was driving. That was your 100% winning point ('no keeper liability') now binned.
Certainly appeal to POPLA if you want but don't pay it even if you now lose. Nothing will happen.

That is a real penalty notice, not a fake APCOA one. POPLA does not come into it. You will have to decide whether to plead guilty and pay the fine or challenge it in a magistrates court.
If you know the ropes, it is extremely difficult for the TOC prosecutor to make one of these charges stick because they have to prove "ownership" and there is no proper way they can do that "beyond a reasonable doubt". The standard of proof is much higher in a magistrates court than in civil court.
If they don't bring a prosecution within 6 months of the date of the alleged offence, that will be the end of the matter.1 -
Sorry to resurrect an old thread, but I have a basically identical situation
APCOA, railway land, TPE ticket (very much like pictured), did not appreciate the "until midnight" nature of tariff (IE my mistake, but easily overlooked when using the app).
However, I have not yet made an appeal. And I legitimately wasn't driving the car either.
Ticket was issued 3 days ago.
What is my best course of action here?0 -
Appeal as keeper to APCOA using both points
No keeper liability because schedule 4 of Pofa2012 doesn't apply on railway land
Not the driver, so you are not liable as you were not driving
No blabbing about who was driving or about what happened
Study other Apcoa railway station threads for the typical template appeal for station pcns1 -
