Resolve call & ACI help

Options
A couple of weeks back we got a knock on the door from resolve call (I've not received a letter from them so not sure what company it was for).

I have recently had a letter from ACI informing me that I've a debt for 800 and that someone from perch verify will be knocking on the door.

Now I've not had anyone knock on my door for years and I wasn't home - my partner was and she understandably panicked and said that I dont live there & she doesn't know me.

Now I've got a few questions - im assuming that perch verify wouldn't send resolve call around on their behalf would they?

And how do I approach ACI regarding them sending someone around? Do I send a prove it letter? And to which address, I notice they have one in Blackpool and one in blythe.

My debts are from probably 15 - 18 years ago and I've not communicated with anyone since then - looking at my credit record, nothing is showing on there. So they should be statute barred.

Also regarding resolvecall - would you just ignore this last visit until I get a letter or would you send a letter asking them for proof of a debt?

Thanks in advance for your help 🙂

Because your debts originate from much more than six years ago, for all intents and purposes they will now be statute barred as long as you have not paid them, or acknowledged them in writing, and no legal action has been taken with any of them.

Resolvecall/Perch are nothing to worry about (see other threads on them in this forum) they are just private companies who specialise in doorstep collections, they have no authority or statutory power of any kind, just people doing a job, who can be ignored or told to go away.

What`s important here is that absolutely nothing can come of this, nothing.

If any of these companies can ever be bothered to write to you, send the statute barred letter in response, until then they are harmless and can safely be ignored or laughed at, whatever your preference.

  • Thanks for your reply, so now you would recommend sending a statute barred letter to ACI rather than a prove it letter?

And do you think the resolvecall door knocker would be with regards the ACI letter? Even though they said perch would visit?

Ideally i want to stop the door step collectors turning up.

    Thanks again for your help

As long as you don't encourage them by engaging and offering payment, the visits will stop.

You don't really know what this is yet.

When you get a letter, if you get enough info to identify it as your debt from 18 years ago, send a statute barred letter.

    Otherwise, send a prove-it

These guys have given great advice, ignore them until you at least know what the "alleged" debt is for.

I had two debts recently given to ACI to have a go at, as you will find on this forum a database of total garbage debt was bought, it has no value except that of trying to persuade vulnerable people that they owe it when they know it is statute barred.

Perch Group have debt ACI), doorstep (Verify) and legal (TMLegal) but none of these can do a thing if the debt is statute barred, i.e. went for 6 years with no acknowledgment of the debt (you making a payment, or asking for time to pay or admitting the debt in some other way).  The six years runs from the date of default or last acknowledgement/Payment.

If a creditor got a CCJ before the 6 years was up then they would have written and bragged about it, but you can do a search of your credit record or check with Registry Trust company for a CCJ.

It is possible that Verify subcontracted it to ResolveCall but my guess would be that ResolveCall is seeking a different debt.

ACI told me that Verify would be coming but said Verify would be letting me know when, that has not happened and I wonder if this is as far as they go because they are in breach of FCA Conc rules and consumer duty.

You can expect ACI to be sacked by the debt manager (e.g. Capquest) who will appoint a new debt collector every 3 to 6 months.

Once you know what the alleged debt is for then you can quote chapter and verse, report them and so on, but be sure to wait until you have a letter showing the source of the alleged debt.  It might be any old debt you had, the ones they are chasing me for went to meet their maker in around 2012 I think.  No need to call them, I never engage except with formal complaints to FCA and FOS once I have evidence of their misconduct.

  • Thanks everyone, much appreciated,

The letter ACI sent specify a  catalogue debt and the amount, ive also received a letter from perch saying theyll be out within the next 14 days - had a text message specifying this too which happened to be on the day of the resolve call visit - not sure how they got my number (i probably should've specified all this earlier). I know who the original debt is with regarding the ACI letter - its from around 2009.

I've searched my credit records and dont have a ccj on it, I've been checking my credit record for about the last 8-9 years and one was not on it then either.

I would respond to ACI`s letter by sending a statute barred response then, tell them they are wasting their time here.

The doorstep brigade are only acting on ACI`s behalf and will soon wither away or be called off.

  • I sent a statute barred letter, which was delivered at the start of this week, but ive just had a letter posted by hand with a hand written start of the letter stating to contact them. What do i do next, just wait for a reply? As they've only had my letter a couple of days?

Also I found an old letter from the end of last year which had the same reference to a text message I received from opos this last week that I didn't respond to should I send a statute barred letter to them aswell? Or wait  ive not had a letter from them in 6 months?

Panicking a little bit at the moment so will appreciate any help

    Thanks in advance

It's not unusual for resolve all to just post a note through the door; it's what they are paid to do.

    Just ignore.

The debt is, for all intents and purposes, statute barred, and you don`t have to pay it, you have nothing to panic about here.

These collection companies are under contract to post letters, it will take a month or so for the contents of your letter to be acknowledged, nothing happens quickly in the world of debt collection.

Just stop thinking about it, as its now irrelevant, as are the company that bought it.

Would you send a statute barred letter to the OPOS people who texted me recently now that ive found a letter from 6 months ago? or just wait for a further letter from them?

It's weird how theyre all coming from under the rock all of a sudden though
