There’s no additional monetary element for LCW on UC.

No idea about the illegal thing. Do you mean you’ve been benefit capped?

Can I be honest... from general observation.... you've had 4 recent threads and the information in them is limited and confusing with many outstanding questions and with no real answers. I suspect the best way for you to get advice is to get all paperwork whether regarding relative situations or as in the last 2 threads your own... and arrange to speak to Citizens Advice or similar. (I note in the 4th last relative matter you did go to CAB). I really think you need to sit down with someone you can engage meaningfully with who can see real facts and ask pertinent questions and get complete answers so full advice can be accurately given and help provided. There's a massive risk we try to guess at information or underlying issues we may have no clue about the detail or existence of, possibly try to link them, and give you bad advice. In this thread what is presented doesn't make much sense as legality doesn't sound like the sort of issue that should be coming up aside from applying benefit rules. All in all 3 previous threads there is not sufficient or reliable information to give proper advice or opinion. So I do suspect MSE is not a good environment for you to get advice and CAB may be far better. People on MSE invariably try to help... but in doing so sometimes we can give extremely poor advice and absolute incorrect information because of poor information input and I absolutely see high risk in your threads of this happening. It's important you do get tailored and correct/sensible advice.

Thanks both, no cap that I'm told just said if they paid the LCW it would take me over the limit abd it was illegal. Sorry if anyone thinks other post responses are a bit vague. I struggle with understanding lots if things so sometimes just get overwhelmed and think best to leave it or I get anxious anyway. But thank you fir responding I do appreciate it 👍

When were you awarded LCW for the first time?  If it was after April 2017 they don't pay the LCW element at all.  (They don't pay it to anyone who was awarded LCW for the first time after then.)

Hi, yes after 2017. Its just never been explained by them in a way I understand. So that's it then its right I don't get it paid. Just wanted to check cos I contact them and can be pretty blunt when I say I didn't understand

Yes, based on the information here.

(Edit: technically I suppose it would be 'illegal' to pay it to you because the law says only people who were awarded LCW before April 2017 can be paid the extra element.)

Just to double check, did you claim ESA before, or only ever UC?
