Damaged Luggage

hopefully this is the right thread, please advise otherwise.

I am looking for some advice please.

recently we returned from a holiday abroad and one of our suitcases got damaged.

to cut a long story short.
after waiting for 7 1/2 weeks (and several requests in-between for an update.

they claim the suitcase (first one offered) was out of stock.
then the replacement one offered was also out of stock.

they originally requested the receipt, for which I was able to provide.

My query is now after 7 1/2  weeks waiting and threatening to escalate the matter.

I have now been offered the original price paid (£14:99) to settle the matter

can I request a suitcase on a like for like basis.

or do I have to accept their offer.

    If the suitcase was originally £14.99 then take the offer. Or you can hold out for a like for like suitcase which in reality is a second hand case which was only £14.99 when new so now probably not worth a tenner.

    Your policy book will state how claims should be settled, including if its on a new for old basis or indemnity. 

    Is the suitcase still made? can you find any links to show its current retail price or what it was last sold for if its now discontinued? 

    Was it just the suitcase that was damaged and no contents? What's your policy excess? Ours is a £75 on damaged luggage so any claim for a cheap suitcase will always ultimately result in a nil payout because it's below the excess.

    Who is paying the claim?

    I am surprised that amount isn't below any insurer's excess.

    Are you planning on making a claim for £14.99 on your travel insurance? 🤔

    just to clarify this is NOT an insurance claim

    it is a claim for a damaged suitcase submitted after a flight.

    My query is really do I have to accept the offer, after being told I would get 1 suitcase then another (after the original one offered was out of stock)

    now they are offering me the original price paid, which was an end of line sale at the time
    so I doubt I will be able to buy a similar suitcase for £14.99

    I would prefer a new like for like replacement

    Is the suitcase still being made? If you can source one you may be able to persuade the airline to get it for you or to pay an equivalent sum, but if it's isn't being made you can't reasonably ask them for something they can't provide.  Plus you are asking for a new case to replace a used one, which I would think they are likely to refuse.
