Nationwide and Moorcroft Debt Help Needed.

Hi,

I’m looking for some help with a credit card debt with Nationwide/Moorcroft.

Sorry if this is a bit long winded….

Back in August 2018 I defaulted on a Nationwide Credit Card which sat on my credit file. The Card was originally applied for back in 2007.

In that time I never contacted Nationwide or acknowledge the debt and they never chased me for it and I was in a really tight spot back then.

In August 2024 the default dropped off my credit file, then reappeared a month later.

Fearing a CCJ I contacted Nationwide 16th August 2024 by phone for information about the account and requested the CCA. Heard nothing back.

Eventually I wrote the standard letter available on National Debt Advice requesting the CCA and statements.

13th September I receive a letter from Nationwide with Statements but NO Credit Agreement.

“On this occasion we have been unable to locate an original copy of your credit agreement. As a result, we’ll be unable to obtain a court judgement against you in relation to your debt etc”.

I then sent them the time has run out letter on October 23rd as I believe that the debt is now Statutory barred. All by recorded delivery.

Everything goes silent, so I call them to find out why they have not sent any confirmation. Guy on the phone tells me he has spoken to the experts at Nationwide and as I spoke to them on the phone and contacted them it’s not Statutory Barred. Possibly this is correct? I’m not an expert.

Nationwide have now passed the debt to Moorcroft, who are relentlessly perusing.

I told them there is no Credit agreement and until that is produced, nothing is happening.

They then send a letter with a load of statements saying - here is your statement/agreement. Defienatly no CCA attached.

I informed them that nationwide had already written to me saying they could not locate a CCA.

I received another letter from Moorcroft saying the following:

"Further to your recent communication in respect of the above account, we are writing to confirm we have been in contact with NATIONWIDE BUILDING SOCIETY.

Upon review of your account our client have advised as this was applied for online, there is no signed agreement. We have previously provided statements which show valid repayments to the account showing that you are liable for the debt."

Anyone have some good advice for what to do next?

Stop chasing them. It's their job to chase you, not vice versa.

I received another letter from Moorcroft saying the following:

That is complete nonsense and they know it.
