    I have just spoke to link and confirmed it is a genuine incident. They account they hold is a Newday Loan and they confirmed the information which had been sent to somebody else was my loan application which would contain addresses, financial information etc. would £250 still be fair in this circumstance?
    I would say it is very generous, normally I'd have expected a much lower sum plus the offer of CIFAS protective registration (£30 for two years)

    How much are you paying a month in the DMP? The reason for asking is if they are getting very little eg £8 a month, then asking them to write off the debt is a reasonable proposition. If they are getting £75 a month from you, then they wont consider doing that

    I'm quite serious, given that they would have only paid 10% for the debt then the proposed compensation could easily be more than they paid for the debt. I don't know what the chances of them agreeing are, bit given some of the tricks these companies try and pull I'd certainly be suggesting it and kicking up a fuss before I agreed to anything else.

    For ref. My wife sent a GDPR letter to a debt company as they kept calling her work (leaving messages with reception / answerphone) the letter she sent, said was only to be contacted a writing, they continued to call, and had to send a further 2 complaints, all she got was £75!

    Yes, I think I would be starting with the email asking for full disclosure. OP has nothing to lose and they may well take the view that it is worthwhile to write it off to get him to go away.

    Investigating things like this under a regulator's eye is a costly nightmare for DCAs.

    I think you need to await their response to your email. I suspect this will be with their legal boys and girls so don't hold your breath, although a reminder after 10 working days would seem appropriate.

    I'm no expert but I think you've asked some fair questions which deserve an answer.

    Unexpectedly received a reply just now posted below, the attachment is my whole application and also details of how much was owed when they brought they account

    ”Thank you for your recent email. It was a pleasure speaking with you yesterday.

    I can confirm that the copy of your application, which was inadvertently sent to another customer, included the following information:

    • Personal Information: Full name, address, phone number, email address, and signature
    • Account Information: Account summary, loan agreement, and agreement terms and conditions

    Please find attached a copy of the document that was enclosed in error.

    This incident was the result of human error, and we were made aware of it by the customer who received your Section 77/78 request dated 28thSeptember 2022.

    We sincerely apologise for this error and would like to work with you to resolve this matter as swiftly as possible. The issue has been escalated to our Compliance Officers for further investigation and appropriate action.

    Should you have any further questions or concerns, please do not hesitate to contact me directly.  ”
